TOTAL INSANITY.

This is another attempt by this administration to curb ALL immigration, even if lawful. People to have come as visitors (with visitor intent) and then had a change in circumstances have been allowed to adjust their status to permanent resident, eg case of marriage to a U.S. citizen. The safeguard have already been in place e - USCIS adjudicators have always been instructed to examine evidence of the applicants original intent at entry to decide if they had immigrant intent. If an adjudicator found they did have immigrant intent which violated their nonimmigrant entry, they could deny the application.

It is far more INEFFICIENT to process immigrant visas through the consulate because of the lack of resources. Wait times are already too long. USCIS has the resources for this because it is largely funded by the applicants filing fees.

Even more dangerous (and likely intended) is this will curb more immigration because when some people depart to have their immigrant visa processed abroad they will trigger 3-year or 10-year bars to reentry. Imagine you want to marry someone from abroad but you have to wait an extra 1 year (current “normal” processing time) or 3/10 years to be together?!

Expect lawsuits and injunctions to be filed very quickly.

USCIS is applying long-standing law and prior court decisions to require certain aliens with temporary visas who decide they want to permanently reside in the U.S. to return to their home countries to apply for permanent visas through the U.S. Department of State.
