A Kanawha County Circuit Court judge has approved a $700,000 partial settlement in connection with the 2023 death of Nathan Kennedy at the North Central Regional Jail.

Forbes Law Offices, along with Calwell Luce di Trapano and John & Werner Law Offices, represents the Kennedy family in its pursuit of accountability.

While this settlement is an important step, the case is not over.

“Something has got to change,” attorney Jesse Forbes said. “No one who makes a mistake should die in custody while waiting for justice.”

“This settlement with the state provides meaningful accountability for what happened to Nathan Kennedy, but it does not bring Nathan back to his family and it does not end this case,” said Attorney Jesse Forbes. “When the state takes custody of someone, that person depends upon the people running the jail for their most basic needs and medical care. Nathan’s family hopes this settlement sends a message that those responsibilities matter and that what happened to Nathan cannot be allowed to happen to someone else.”
