Ever wonder about titling assets between spouses or others with survivorship?

Titling real estate or assets (like a car) with survivorship is a type of joint titling between two or more folks. The rationale is to ensure that the asset transfers to the other party or parties immediately upon death of one party, outside of probate.

SOUNDS LIKE A GREAT IDEA! ...WITH THE BEST OF INTENTIONS! ...WHAT COULD POSSIBLY GO WRONG?

Like every great idea, there are drawbacks. If a party is incapacitated - brain injury, stroke, dementia, etc. - but does not die, the remaining owners cannot do anything with the asset. Why? Because the incapacitated party did not die, the asset will not transfer. If he or she cannot sign due to incapacity, the asset is stuck. This happens A LOT with married couples.

A General Durable Power of Attorney solves this problem. EVERY married couple needs a POA appointing each other and possibly a successor. In fact, every individual needs one. It is an inexpensive solution to what happens if a person becomes incapacitated. Important note - your agent MUST be someone who is trustworthy.

Contrary to popular belief - it is NOT illegal to drive without shoes.

There are no statutes in the following states that prohibit operating a motor vehicle without shoes (despite the ever-present rumor):

Virginia — No law requiring footwear while driving.
Tennessee — Barefoot driving is legal.
Kentucky — No prohibition on driving barefoot.
West Virginia — Legal to drive without shoes.

Hope that clears it up. LOL.

Revocable vs. Irrevocable Trusts: What’s the Difference?

Revocable Trust:
• You can change or revoke it anytime during your lifetime
• Helps avoid probate and manage assets if you become incapacitated
• Assets remain part of your estate for tax and creditor purposes

Irrevocable Trust:
• Generally cannot be changed or revoked once established
• Offers stronger protection from creditors and lawsuits
• Can help with Medicaid planning and reduce estate taxes

Choosing the right trust depends on your goals. The Reliance Law Group can guide you through the options and help create a plan tailored to your needs. Contact us to learn more!

Thinking about flying a drone? Here are a few important FAA rules every drone operator should know:

✅ Most drones weighing more than 0.55 lbs must be registered with the FAA
✅ Recreational drone pilots must pass the TRUST safety test
✅ Maximum altitude is generally 400 feet above ground level
✅ Keep the drone within your visual line of sight at all times
✅ Do not fly over people or moving vehicles unless specifically authorized
✅ Avoid airports and restricted airspace without proper authorization
✅ Commercial drone use generally requires an FAA Part 107 Remote Pilot Certificate
✅ Never operate a drone recklessly or while impaired

Drone technology is advancing rapidly, but the laws and regulations are evolving just as quickly. Violations can result in substantial civil penalties and, in some cases, criminal charges.

Whether you use drones for recreation, photography, inspections, mapping, agriculture, or business operations, understanding FAA regulations is essential.

Questions about drone laws, liability, business use, or municipal regulation? The Reliance Law Group is here to help.
