As we head into the final stretch of the year, a lot of small business owners are taking a closer look at where things stand — and as a small business owner myself, I’m doing the same.
The fourth quarter is a time to:
✅ Review contracts and outstanding obligations
✅ Look closely at cash flow and end-of-year expenses
✅ Think strategically about growth or changes for the new year
✅ Tackle any issues before they grow bigger in Q1
But this is also the time when I see potential legal issues start to surface — contract disputes, business breakups, collections, and other matters that can quickly become litigation if not handled carefully.
At Anderson Legal, we work with business owners across North Carolina to protect what they’ve built. Whether it’s resolving a dispute before it escalates or litigating to enforce your rights, we’re here to help you move into the new year with confidence.
If legal issues are on your year-end to-do list, let’s talk before they turn into bigger problems.

📸 Behind the scenes at Anderson Legal!

We recently swapped our desks for the camera lens and took part in a team photo shoot — and it turned into much more than just updating our headshots.

What started as a simple shoot became a reflection of who we are, what we do, and why it matters. It reminded us of three big things that shape how we serve our clients every day:

🔍 Preparation
Every photo took planning — outfits, lighting, the message behind each shot. Just like in our legal work, the best results come from thoughtful preparation. It’s not just part of our process — it’s a promise to our clients.

🤝 Teamwork
It took a full crew to make this shoot happen: our legal team, our amazing photographer, and support behind the scenes. The same goes for how we handle our cases — with collaboration, communication, and trust.

⚖️ Expectations
People often picture lawyers as polished and confident — and we aim to be that. But there’s a lot more behind the scenes: late nights, big decisions, and the responsibility of guiding clients through tough situations. We take that responsibility seriously — and we’re proud to show up with heart and integrity every day.

At the end of the day, it’s not just about looking the part — it’s about doing the work when no one’s watching.

Huge thanks to our Anderson Legal team for showing up fully — on camera and off. 💼❤️

Thinking About Litigation? Here’s What You Should Know About the Timeline ⏳

At Anderson Legal, PLLC, many of our clients are going through the litigation process for the very first time. One of the most common questions we hear is: “How long will this take?”

The answer isn’t always straightforward—but here are a few important things to keep in mind:

✅ Every case is different.
Some cases settle quickly, while others can take many months—or even longer—to resolve. There’s no “one-size-fits-all” timeline.

✅ Court deadlines take time.
The legal process involves waiting periods. For example, filings and responses often have 30- to 60-day deadlines, which means you may be waiting on the other side for quite a while.

✅ Your time matters too.
Clients play an important role in their case. You’ll need to set time aside to meet with your attorney, prepare for depositions, attend mediation or court, and review documents.

✅ Court dates aren’t immediate.
Even after requesting a hearing, it can take weeks before the court is available. Patience is key in this process.

At Anderson Legal, we guide our clients through each step with honesty, care, and a clear understanding of what to expect. If you’re thinking about taking legal action—or already involved in a dispute—we’re here to help you make informed decisions.

🦈 Looking for a “Shark” or “Bulldog” Attorney? Let’s Talk About What That Really Means. 🐾

As litigators, my team and I often meet potential clients who say they want a “real shark” or a “bulldog” attorney.

My first response is always the same:
“What does that mean to you?”

Most people pause. They know they want someone strong, committed, and effective—but they’re not always sure what that actually looks like in the legal world.

Here’s what I believe a real “shark” or “bulldog” attorney should be:

✔️ Well-versed in the practice area
✔️ Passionate about your case
✔️ Strategic—tailoring their approach to you
✔️ Timely and proactive with your matter
✔️ Personally invested and communicative
✔️ Honest and realistic about your chances

And here’s what a real advocate isn’t:

❌ Not someone who bullies or harasses the other side
❌ Not someone who confuses aggression with effectiveness
❌ Not someone who relies more on relationships than skill
❌ Not someone who overpromises just to get your business
❌ Not someone who wastes your time or money on needless actions
❌ Not someone who disrespects court rules or processes

At Anderson Legal, we focus on litigation that gets results—with strategy, integrity, and professionalism. Whether you’re facing a business dispute, construction issue, or real estate conflict, we’re here to guide you through it with confidence.

Thinking About Lending Money to a Real Estate Investor? Read This First. 🏠💸

We've recently had a wave of clients come to Anderson Legal because they loaned money to real estate investors—and now they’re struggling to get paid back.

Private lending can be a smart way to earn passive income, but it comes with real risks. Before you hand over your money, here are some ways that may protect you:

👉 1. Get It in Writing (The Right Way)
That means more than a handshake or a Google template. Your agreement should include:
• How much you're lending and the repayment terms
• What happens if they default
• Your rights to foreclose or take legal action

Every deal is different. Be sure to have an attorney review the documents on your behalf. A solid contract can save you major headaches later.

👉 2. Secure the Loan With the Property
Make sure there’s a recorded Deed of Trust or Mortgage tied to the loan. Without it, you're just another unsecured creditor if things go south. You will want to know if there are any other senior liens on the property. If there are, your Deed of Trust or Mortgage may be insufficient to protect you.

With it, you have legal rights to the property—including foreclosure if necessary.

👉 3. Do Your Homework
• Is this investor trustworthy and experienced?
• What’s the property really worth?
• Are there other debts on it that might affect your position?

A little research now can prevent big problems later.

👉 4. Follow the Law
North Carolina has strict rules around interest rates and private loans. If your terms don’t comply, your loan might not be enforceable—and you could even face penalties.

💼 At Anderson Legal in Cary, we help private lenders structure and secure their loans the right way. If you’ve already lent money and are having trouble collecting—or want to make sure your next deal is airtight—we’re here to help.

🔍 Busting Common Myths About Civil Litigation in North Carolina
From the team at Anderson Legal, PLLC

If you're a business owner, property owner, or contractor in the Triangle area, chances are you've heard at least one of these myths about civil litigation. Let's set the record straight:

💭 Myth #1: “All civil disputes end up in trial.”
✅ Fact: Most cases don’t go to trial. Many are resolved through motions, negotiations, or settlements—which are often faster, less expensive, and at times private.

💭 Myth #2: “Litigation always takes forever.”
✅ Fact: While the process takes time, many disputes are resolved within months. Your attorney can help manage timelines and expectations from day one.

💭 Myth #3: “You don’t need a lawyer—you can do it yourself.”
✅ Fact: Legal procedures, court rules, and deadlines are complex. One mistake can cost you. Our attorneys know how to build strong cases and protect your rights.

💭 Myth #4: “It’s always worth suing, no matter how small the amount.”
✅ Fact: Not always. Sometimes, legal fees may exceed what you’re trying to recover—especially if attorney’s fees aren’t recoverable. We help clients weigh the pros and cons before moving forward.

💭 Myth #5: “Going to court is the only way to win.”
✅ Fact: Not true. Well-timed negotiation can lead to great outcomes—saving time, money, and stress while still protecting your interests.

💼 Did you know that in North Carolina, 95–96% of civil lawsuits never make it to trial?

At Anderson Legal, we’ve seen firsthand how most civil cases are resolved long before anyone steps into a courtroom. In fact, many courts in NC require something called mediation before a case can go to trial.

🤝 So what is mediation? It’s a process where a neutral third party helps both sides talk through the issues and work toward a resolution. It’s private, less stressful than a trial, and often leads to creative solutions that work for everyone.

One big advantage of settling a case—whether it’s early on or even just before trial—is that both sides keep more control over the outcome, rather than leaving it up to a judge or jury.

If you’re involved in a civil dispute, our team at Anderson Legal is here to help you understand your options and work toward the best possible result—whether that’s through settlement or trial.
