Most business owners run a trademark search, see their name is taken, and give up. They rebrand, start over, and lose months of work - when they didn't have to.
Here's what they didn't know. Trademark protection is not absolute across every industry. It's tied to specific classes of goods and services. That means two completely different businesses can legally own the same trademark as long as there's no likelihood of confusion between them.
A bakery and a software company could both own the name "Summit" because no reasonable customer would confuse the two. The key question the USPTO asks is whether consumers would be confused about the source of the goods or services - not just whether the names look similar.
Now, this isn't a green light to file without doing your homework. There are factors that complicate it - how famous the existing mark is, how similar your industries are, and whether there's any overlap in your customer base. That's exactly why a proper trademark clearance search matters before you file anything.
