🏛️ TRIAL? WAIT… WHAT?! 😯
Have Lawyers Become Too Hesitant to Take a Case to Trial?

⚖️ ASK KARA - Trial Is Not Always the Best Answer! Lawyers are thoughtful about whether a case should go to trial. Civil litigation can be expensive. Sometimes, settlement is the smartest and most practical outcome.

⚖️ ASK ROBSON - Attorneys Must Be Prepared to Try the Case! Too often, cases are advanced with the hope they will settle in arbitration or before reaching the courtroom.

A strong advocate should evaluate the costs, risks and benefits—but also be prepared to take the case as far as necessary to protect the client's interests.

⚖️ CONCUR OR OBJECT: Should Mediation Be Required Before Trial?

🟩CONCUR: Mediation should be required. It can be highly effective—and why go to trial if the parties can resolve their dispute themselves? Mediation gives both sides a voice and allows them to reach an agreement they have a say in creating, while potentially saving time, expense, and uncertainty.

🟥OBJECT: But the goal shouldn't be simply checking a box.

If the parties cannot reach a settlement, another form of dispute resolution may make more sense. Arbitration could provide a neutral decision-maker who can evaluate the dispute and, when appropriate, determine damages rather than simply pushing the parties toward settlement.

👉 Should mediation be mandatory before trial—or should the parties have more flexibility to choose the best path to resolve their dispute?
