PTNNSYLVANIA’S NEW DUI LAW, ACT 59 OF 2022 OTHERWISE REFERRED TO AS “DEANA’S LAW” INCREASES SENTENCING FOR REPEAT DUI OFFENDERS SIGNIFICANTLY.
SOMEOF THE CHANGES ARE AS FOLLOWS:

1. IF A PERSON REFUSES TESTING OR A BREAT OR CHEMICAL TESTING AND HAS TWO OR MORE PRIOR OFFENSES COMMITS A FELONY OF THE THIRD DEGREE. AND A FELONY OF THE SECOND DEGREE IF THE INDIVIDUAL HAS THREE OR MORE OFFENSES.
2. A THIRD-DEGREE FFELONY CARIES A SENTENCE OF NOT MORE THAN 7 YEARS IN PRISION.
3. A SECOND-DEGREE FELONY CARIES A SENTENCE OF NOT MORE THAN 10 YEARS IN PRISION.
4. A SENTENCE INHANCEMENT IS REQUIRED FOR ANY INDIVIDUAL CONVICTED OF A DUI AND REFUSES A VREATH OR CHEMICAL TEST THAT IS COURT ORDERED OR SEARCH WARRANT.

BEING CHARGED WITH A DUI IN PENNSYLVANIA HAS TAKEN ON A WHOLE NEW MEANING. SO, IF YOU DO NOT WANT TO SPEND 7 TO 10 YEARS OR MORE IN PRISION, PLEASE DO NOT DRINK AND DRIVE!

Time and time again I ask my client if they talked to the police or made a statement and they claim that they didn’t say anything. Then I submit my request for discovery and I receive a video of my client in an interrogation room singing like a canary. You cannot outwit the police. This is their job and they are very good at doing their jobs. Police can lie and trick you into confessing. They can claim to have witnesses or videos of you committing the crime. They can claim to have your DNA. There is only four words you should ever say to the police when being questioned, I WANT MY LAWYER.

MEDICAL MA*****NA
THE FACTS AND THE LAW.

You finally received your medical ma*****na card. You can now legally puchase, possess and use ma*****na.

WRONG!!!

SOME FACTS TO PONDER.

1. Ma*****na in it's plant/vegitative state is still illegal.

2. You can only ingest, vaporize or use a nebulizor.

3. Medical Ma*****na is sold in a package withlots of interesting facts on the label. The police look for that label to verify whether the ma*****na was leagally purchased. Therefore, if your medical ma*****na is not in it's original package, you are not in legal possession despite having a medical ma*****na card.

4. Ma*****na is still classified as a schedule 1 substance. Therefore, if you test positive for ma*****na while driving, you can be charged with a DUI in Pennsylvania.

It can be a frightening time for someone who is facing criminal charges. It is hard to know who you can trust. The one person you can trust is your lawyer. Anything you tell your lawyer is protected by attorney client confidentiality and cannot be used against you. That being said, the greatest harm you can do to your criminal case is to lie to your lawyer. Protect yourself - trust your lawyer.
