When I ask my estate planning clients if they have any personal items (heirlooms, jewelry, etc.) they would like to pass to a specific person, many if not most respond with something to the effect of, "no one wants my junk," or "my stuff doesn't mean anything to anyone but me."

So I tell them the story of my Christmas tree.

After my wife, Kim, died I had to decorate for Christmas. That was Kim's thing and she loved it, but now I had to pull out all the bins and do the thing. I came across a ceramic Christmas tree Kim would put out every year and figured why not.

When I opened the box I discovered a note Kim had written. The tree had been a gift from her grandmother. Knowing how much it meant to Kim turned what had been just another Christmas decoration into one I cherish most.

As you move through this holiday season, I encourage you to consider how you might share the life you've built and the things you cherish with the people you cherish.

Those who love you will want to feel connected to you after you're gone. The giving of final, meaningful gifts can be that bridge to a cherished legacy.

Though enforcement of the CTA has been (temporarily) blocked in the courts, FinCEN continues to expect compliance with the reporting deadlines. Small businesses who avoid submiting their BOI report can face daily penalties for noncompliance if the temporary injunction is lifted and they have not submitted their BOI report. It is estimated only 30% of reporting companies have filed their BOI report.

The Corporate Transparency Act requires many businesses to file data about their "beneficial owners" by Jan. 1. But the rule is being challenged in court.

Last month, I had the privilege of meeting some wonderful people at CaregiverCON, the first of hopefully many conferences designed specifically for the family caregiver.

This particular guest was perhaps less interested in creating a Health Care Directive and more interested in what type of meat was on my sandwich - but I've never met a therapy dog I didn't like!

If you, or someone you know, finds themselves in the role of caregiver to someone with a catastropic diagnosis, I encourage you to look up The Negative Space and Jack's Caregiver Coalition - both are building communities for family caregivers to feel less alone and better equipped for the challenges they face. Next year's CaregiverCON is set for Nov 1, 2025.

Attn: Business owners! ~ The Corporate Transparency Act (2021) has important upcoming deadlines for reporting the Beneficial Owners of all non-exempt entities.

There is a daily fine for non-compliance that is inflation-adjusted - meaning the fine increases with inflation!

You can file your BOI report with FinCEN at no cost - or if you want to minimize how much space reporting takes up on your plate - reach out and we can support you.

As of 12/3/24 a preliminary injunction has (at least temporarily) halted enforcement of the CTA - meaning filing *may not* be required if the law is ultimately deemed unconstitutional or is repealed. It is recommended that filings be prepared to mitigate risk in case the injunction is lifted and enforcement resumes.
