It is a privilege to advocate for persons who have been injured and move the law in direction of being more just and more protective of public safety. My Associate, Matt Shagam, and I would have been happier if the Court had adopted a broad duty for mental health professionals to act reasonably to protect the public. It did not seem like too much to ask.
But law moves towards justice in fits and starts, and recognizing a duty to warn caregivers in the rare cases where mental health patients are dangerous, is a step in the right direction.
Thank you, Andrew Delaney, for a quick and effective summary of the Supreme Court's 61 pages of opinions in this case.

This case -- Kuligoski v. Brattleboro Retreat -- is a big development in Vermont tort and mental health law.
