Cars crashing into restaurants, convenience stores, and shopping centers is a common occurrence. The reasons why this happens varies and can be due to many factors such as inattention, mistake in shifting to park, foot slipping off the pedal or a medical illness or seizure. One common theme is the landowner or business fails to place any protection for the building from vehicle traffic (such as a bollard, rock, concrete wall).

Shurtleff Law successfully helped a young man with serious injuries from this type of crash recently. We hope all of those injured at the restaurant a full recovery.

Sometimes you just take a case because you believe in it. Sometimes you just get a dog of a case.

After over a year of not having jury trials, Brazos County Court at Law No.1 conducted its first jury trial last week. Shurtleff Law was successful in obtaining a jury verdict in favor of our client Morgan Seekatz regarding permanent possession of her personal property (a dog!). Morgan did a great job, the jury loved her. Fantastic work by the whole team including Marca Theresa Ewers-Shurtleff

We all love our dogs. They are part of our family right? Interesting side note on Texas law regarding damages available for the loss of a family pet: Can a dog owner recover emotional based damages for the loss of a dog? The Texas Supreme Court says no. The law says that pet loss (just like other personal property) is limited to the market value of the pet, and a court cannot award damages for loss of relationship, love or companionship.

Your contract may have provisions that provide relief based on the current State and local orders declaring a state of disaster.

A" force majeure" clause may be in your contract. It's a $10 lawyer term that provides excuse from performance based upon unforeseen events: acts of God, strike, fire, flood... and depending on the terms, acts of any local, state or federal government.

Additionally, Texas law recognizes that performance by a party under a contract can be excused under the doctrines of impossibility of performance, commercial impracticability, and frustration of purpose. After a contract is made, a party's performance may be made impracticable or impossible without fault by the party, preventing the ability to perform the basic assumption on which the contract was made.
