🚨⚖️ Final Removal Order? A New BIA Decision Changes Bond Options
In Matter of W-F-D-, the BIA held that Immigration Judges generally lose authority to redetermine custody once a removal order becomes administratively final.
That means someone who might have been eligible to request bond before the order became final may need to pursue different options afterward, such as a DHS post-order custody review or, in some cases, a federal habeas corpus petition.
This decision is also a reminder that deadlines matter. A late appeal can change which detention rules apply and may significantly limit available remedies.
