Dear Attorney Tully: My husband has Alzheimer’s and is in a nursing home. I want to receive the best, unbiased advice possible but I am concerned about the costs. Some of my friends say hiring an Elder Law attorney costs too much. I am not sure if I can afford it and I don’t want to drain the money I have left. What should I do?

Most older Americans want to remain in their homes as they age — and with the right support, many can.

Family caregivers often carry the greatest responsibility, balancing daily care needs with work, finances, and family dynamics. Without proper planning, even well-intentioned arrangements can create stress, resentment, or uncertainty over time.

The good news: more public and private resources are available than many families realize. Home health aides, respite care, adult day programs, meal delivery, transportation services, and limited Medicare/Medicaid support can all help older adults stay safely at home longer.

Long-term care in the U.S. is one of the biggest financial challenges families face, yet much of the conversation around Medicaid planning is shaped by misconceptions.

Here are a few realities worth understanding:

• Medicaid planning is legal. It involves making informed, lawful decisions about assets, often converting them into exempt resources like home improvements or burial funds.
• It’s not “gaming the system.” Most long-term care is provided by unpaid family caregivers, not Medicaid. Families typically turn to Medicaid only after exhausting other options.
• It’s not for the wealthy. Individuals with significant resources generally rely on private planning, not Medicaid, which comes with strict limits and estate recovery rules.
• Its financial impact is often overstated. Even in extreme scenarios, asset transfers represent a relatively small share of total Medicaid spending.

The reality: people don’t plan for Medicaid because they want to - they do it because long-term care costs (often exceeding $200K/year) leave them with difficult, no-win choices.

Better awareness leads to better planning and more informed conversations about how we support aging with dignity.
