CRIMINAL HISTORY IMPACT:
In MO a guilty plea to No Insurance charged in State Court is a MISDEANOR conviction on your permanent criminal record. A guilty plea to No Insurance charged in a Municipal Court is an ordinance violation conviction, ordinance convictions are normally considered "quasi criminal" and not generally perceived as a "criminal record" since it is not a Misdemeanor or Felony.

POINTS ON DRIVER'S LICENSE:
Any conviction for No Insurance will cause 4 points to be added to your MO driving record, regardless of how many times you've been convicted for this offense. Accumulating 8 points in 18 months will trigger a driver license suspension, the length of suspension will depend on how many prior "points suspensions" you have had in your driver history.

1ST CONVICTION:
1) 4 points will be added to your driver's license; 2) Your driver's license will not automatically be suspended for a 1st conviction, unless that conviction has caused you to accumulate too many points due to having prior points on your driver's license already. 3) If this conviction causes you to be suspended due to accumulation of points then after you serve the suspension period you will be required to pay a $20 reinstatement fee to MO DOR which can be paid online at mydmv.mo.gov 4) MO DOR will require you to carry SR22 for THREE (3) years.

2ND CONVICTION:
1) 4 points will be added to your driver's license; 2) Your diver's license WILL be suspended for 90 days, possibly longer based upon the number of existing prior accumulated active points you have on your record, DOR would notify you via mail of the effective date of the beginning of your suspension; 3) After the suspension period you must pay a $200 reinstatement fee to MO DOR which can be paid online at mydmv.mo.gov 4) MO DOR will require you to carry SR22 for THREE (3) years.

3RD OR SUBSEQUENT CONVICTION:
1) 4 points will be added to your driver's license; 2) Your driver's license WILL be suspended for 1 YEAR, DOR would notify you via mail of the effective date of the beginning of your suspension; 3) After the suspension period you must pay a $400 reinstatement fee to MO DOR Which can be paid online at myDmv.Mo.gov 4) MO DOR will require you to carry SR22 for THREE (3) years.

WHAT IS SR-22:
SR-22 is NOT an actual insurance policy, it is a proof document that your insurance company electronically files directly with MO DOR that certifies that you are currently carrying a policy of liability insurance that meets or exceeds MO's required minimum liability coverage. If your policy lapses or is cancelled for any reason your insurance company is legally required to IMMEDIATELY notify MO DOR by electronically filing a form called SR-26, which will trigger MO DOR to re-suspend your driver's license.

MO New Law for Ignition Interlock Devices - (House Bill 1740):

The new law takes effect Friday 8/28/26.

Four (4) main components that change current DWI related laws in MO:

1) ENHANCEMENTS TO CERTAIN DWI PENALTY LAW: DWI with criminal negligence that caused injury to a person, the penalty is enhanced to a Class D Felony. If the injury to a person is "serious" the penalty is enhanced to a Class C Felony. A DWI that causes a fatality, the penalty is enhanced to a Class B felony with mandatory minimum of 5 years before parole. A DWI with a fatality AND a BAC of .15% or higher, OR a DWI causing multiple fatalities, the penalty for either scenario is enhanced to a Class A felony with mandatory minimum of 10 years before parole.

2) BENTLEY & MASON'S LAW: Requires courts to order convicted drunk drivers that are determined to be responsible for a crash involving a fatality that kills a parent or legal guardian to pay child maintenance for the surviving children.

3) EXPANSION TO IGNITION INTERLOCK DEVICE ("IID") RELATED LAW: Any 1st time DWI with BAC of .15% or higher will have mandatory IID. Any DWI offender with 2 or more alcohol related contacts (either criminal or administrative) will have mandatory IID - and a prior "SIS Probation" WILL count as a prior alcohol related contact. Any DWI that involves a crash with injury or property damage will have mandatory IID, including a 1st DWI. There is a new "low income" fee cap for IID, if a driver's income is at or below 150% of the federal poverty line then IID providers must discount their IID fees to 10% of the total device cost, fees related to lockouts & tampering etc are not discounted.

4) ENHANCANCED DWI PROBATION, PAROLE & MONITORING LAW: Mandatory 2 years minimum probation regardless of BAC level. A Judge or Parole Board's ability to allow early probation or supervised release is heavily restricted for a DWI involving a fatality, to require Continuous Alcohol Monitoring (CAM or SCRAM bracelet 24/7 monitoring) paid by the offender. Any DWI with BAC of .15% or higher will be required to participate in DWI Treatment Court Program or alternative program to qualify for an SIS Probation.

That all being said this is a new law and portions of this law may or may not be interpreted differently as they play out in the Courts, interpretation of the details may be litigated, etc.

What is a Flock camera & what is it used for?

A Flock camera is an automated vehicle license plate reader used by law enforcement, businesses, schools, etc. The name Flock comes from the name of the company that installs the cameras.

At our law firm I see police reports containing Flock camera data that ultimately leads to an arrest frequently. A situation as simple as a vehicle pulling into a mall parking lot can result in a plate scan being cross checked against law enforcement database information that then triggers a law enforcement alert. Law enforcement may then respond to that location. That being said, whether law enforcement can then actually detain the driver depends largely upon the facts and circumstances of the situation, the alert alone DOES NOT give police a cart blanche legal ability to detain the driver. The ability to detain the driver requires a legal analysis of 4th amendment seizure issues surrounding each specific situation.

These cameras are typically located on utility poles, streetlights, parking lots, schools, parks and other places, usually connected to a small solar panel or cell antenna. The cameras capture plate & vehicle images, and sometimes can potentially capture a person depending on camera model, placement, angle and direction of vehicle travel, however does not utilize any type of facial recognition technology and does not identify people. The camera information can cause a law enforcement alert if a vehicle/plate has been associated with a crime, missing persons or other reasons. The cameras are a form of mass surveillance shared between jurisdictions and various entities that can potentially track a vehicle’s movement.

St Louis County is now a “no refusal” county effective immediately. There will be a Prosectutor on call at all times to obtain a warrant for a blood draw for DWIs & DUIs when a driver refuses the breathalyzer or is suspected of driving high.
