Getting into real estate investing? Have you thought about how you'll "hold" your properties? It is not a great idea to have your investment properties in your name for the sake of liability. If anything goes wrong with your tenants and they choose to sue you would be personally liable. It is often a better idea to hold your real estate in an LLC. Do you have a dispute with a contractor and want to sue? Not so fast! You are required by law to give them a second chance.

Are you a contractor in a dispute with a homeowner? Good news, you get a second chance. But only if you follow the rules!

If you want to sue a contractor you must provide proper notice of the claim within 15 days of discovering the problem. They get a chance to respond. And you must provide the contractor an opportunity to inspect the defect. You must then allow them a reasonable opportunity to fix the problem!

This may not sound fair, but it's the law of second chances. If you have dispute with a contractor, give us a call. We can review the notices, help you draft a notice, and walk you through the process.

We had a client who had recently bought an investment property and had some questions about how to make the best use of it. Our first question: "how did you buy the property?". We wanted to know if she owned it in her own named or had used an LLC to purchase the property. She had a separate LLC but hadn't put this one in it yet. We highly recommended to her that she add in it in ASAP. Why? Because when you put investment properties into an LLC it allows you to be personally shielded from any liabilities associated with it. This is especially critical if it is a rental property of any kind. Moving properties into an entity like an LLC isn't "difficult" but is a lot of extra paperwork.
