Well, a lady jumped a 7 1/2" curb with all four wheels, went through a cedar pole 8" in diameter, jumped a 4" entrance curb and smashed into my building yesterday.

VICTORY ALERT! A unanimous appellate court handed down its decision yesterday that a judge committed error when he dismissed the medical malpractice claim of my clients, the Hayes family. The Court agreed with us that our expert testimony in the matter is extremely reliable. This wrongful death claim will now be sent back to the trial court for a jury trial.

The decision attached reads like a crime novel, with incompetent care leading to death, exposed lies during depositions, a cool cell phone trick I pulled, and medical records altered by the hospital after-the-fact. I care deeply for these clients and I am proud to be working for them to get justice in these tragic circumstances.

The race for Justice Court Judge in Madison County seems a bit silly to me. Mitch Tyner was born in Madison County (been there 60 years), and has practiced law (college and law degree from Mississippi College) for 37 years. His opponent, nice as she may be, does not have a college degree and has barely lived in the state for ten years. Really?

Oral argument before the Court of Appeals last week in a claim that is quite egregious. It involves medical malpractice by a nurse practitioner (NP) manning the ER at Magee General Hospital. No physician was in the ER, nor was any contacted. Lance Hayes, a husband and father of 3, died at his home about 2 hours after being discharged. The videotaped argument begins at 6:45 below.
