Many of our client's throughout the estate planning process express a similar concern, "What if one of my children receiving my assets gets divorced?"

This is a valid concern, and while the possibility of your child getting divorced is completely out of your control, taking proactive measures to protect their inheritance in such a case is not. 🧑‍🧑‍🧒 🔒

In Massachusetts, it is possible for inherited assets to be susceptible to equitable division during a divorce proceeding. However, through strategic estate planning, the use of a properly structured Trust is one of the most effective ways to protect a child’s inheritance from divorce. 🪙

Estate planning is of vital importance for parents with minor children. When it comes to distributions for their children, parents often state they want things to be split up "equally." 🧑‍🧑‍🧒‍🧒

However, when building out your estate plan, “equal” doesn’t always mean “equitable.” ⚖️

A pot trust structure allows parents to keep assets in one shared fund and give a trustee the flexibility to distribute money based on each child’s individual needs. This ensures that your trustee can account for each child's station in life and unique circumstances, and make distributions as needed for each child's health, education, medical expenses, general support, or unexpected life events. 🪙

It’s a smart way to ensure your children are supported in the same way that you would support them if you were still alive.

💡 Why Estate Planning is Crucial for People Without Children

If you’re single, married without children, in a domestic partnership, or simply don’t have kids yet, having an estate plan in place is still critically important.

Without a Will or a Trust in place, Massachusetts Intestacy Law will control who receives your assets. More importantly, a comprehensive estate plan will include documents that deal with your incapacitation, so a trusted person can step in and manage your financial affairs or make informed medical decisions when you are unable to do so.

A common misconception is that estate planning is only for married couples or those with children. This could not be further from the truth. Estate planning gives you control and the ultimate peace of mind.

📜 Worried Your Estate Plan Might Get Challenged? Here’s What You Can do to Deter Your Beneficiaries From Disputing Your Estate Plan ⬇️

Many people worry about how their estate plan works if someone were to dispute it following their death. A primary strategy we utilize in our estate plans is the use of a "no contest" clause (also referred to as an "in terrerom" clause). These clauses deter beneficiaries from disputing or contesting a Will or Trust. These provisions state that should a beneficiary dispute the instrument, they risk forfeiting their full inheritance that they would otherwise be entitled to receive.

These clauses have regularly been upheld by Massachusetts Courts as valid, and legally enforceable. However, it is vital to understand what they can, and cannot do when it comes to your estate plan. In our latest legal blog post, we discuss how to properly use and draft these clauses, we cite to recent Massachusetts cases and analyze how the courts interpret these clauses, and we review how they should fit into your plan. ⚖️ 🏛️
