What happens in the first 24 hours after Florida removes a child from a parent?

When the Department of Children and Families removes a child, that removal starts a dependency case under Chapter 39, Florida Statutes. The first court date is called a shelter hearing, and under § 39.401 and § 39.402 it must be held within 24 hours of removal. A judge decides whether there is probable cause to keep the child in shelter status while the case continues. Parents have the right to be heard at that hearing and the right to an attorney, including appointed counsel if they cannot afford one.

Florida law is actually built around this idea.

The stated purposes of Florida's divorce statute include promoting the amicable settlement of disputes between spouses and reducing the harm the process can cause to spouses and children (Fla. Stat. § 61.001).

Florida is also a no-fault state. To grant a divorce, the court asks whether the marriage is irretrievably broken, not who is to blame for it (§ 61.052).

And for couples who want to stay out of the courtroom, the Collaborative Law Process Act makes it Florida policy to encourage peaceful, voluntary, nonadversarial resolution (§ 61.55).

The system is designed for resolution, not revenge. Your energy is better spent on the life you are building next.

Divorcing a business owner? The paycheck is only part of the picture.

Under Florida law, business income for support purposes means gross receipts minus the ordinary and necessary expenses required to produce that income. Perks count too: reimbursed expenses or in-kind payments that reduce living expenses are treated as income (Section 61.30, Florida Statutes).

The business itself is also on the table. Florida values marital interests in a closely held business at fair market value, and enterprise goodwill can be a marital asset (Section 61.075, Florida Statutes).

That is why a forensic accountant or valuation professional is often part of the divorce team. The numbers deserve a closer look.
