🚨 Hit-and-run accident? Don't assume you have no case just because the driver was never found.
The belief that "no driver means no compensation" is one of the most common (and costly) misconceptions our attorneys encounter.
Too often, victims assume the case is over. They pay medical bills out of pocket, miss important deadlines, or accept whatever their insurance company offers because they don't realize they may be entitled to more.
The truth is that even when a hit-and-run driver is never identified, Florida law and the insurance framework built around it provide real paths to compensation.
An unidentified driver is generally treated as an Uninsured Motorist under Florida law.
Here are a few things every hit-and-run victim should know:
✅ UM coverage may be your primary source of recovery. If you carry Uninsured Motorist (UM) coverage, it may help pay for medical expenses, lost wages, pain and suffering, and other damages the fleeing driver would otherwise owe.
✅ PIP coverage is only the first layer. Florida's mandatory PIP coverage provides up to $10,000 for medical expenses and lost wages, but it does not cover noneconomic damages. UM coverage fills that gap.
✅ The investigation does not end when the police close the file: Private investigation by an attorney's team, including surveillance footage recovery, debris analysis, and witness canvassing, has identified hit-and-run drivers in cases law enforcement deemed unsolvable.
✅ Comparative fault is no longer the focus. When the at-fault driver is unknown, the case frequently centers on documenting the victim's injuries, damages, and available insurance coverage.
✅ Multiple sources of coverage may exist: UM coverage, Med Pay benefits, household policies, employer policies, and coverage tied to the vehicle involved may all play a role.
Our attorneys treat the first 48 hours after a hit-and-run accident as one of the most critical windows in a case. The decisions made during that time can significantly impact the outcome of your claim.
If you've been injured in a accident, don't assume you're out of options.
