August 21 is now officially designated as Fentanyl Awareness & Education Day in Florida, and now nationally.

Why it matters:

‼️ Fentanyl is a powerful, synthetic opioid, 50 to 100 times stronger than he**in or morphine. It’s often mixed into street drugs or counterfeit pills, sometimes without users even knowing.
‼️ Illicit fentanyl is the leading cause of overdose deaths in the U.S.
‼️ An estimated 77,600 overdose deaths occurred in the U.S. in the year ending March 2025, with most involving synthetic opioids like fentanyl.

How you can help prevent tragedy:

✅ Lead with empathy. Addiction is complex – support recovery, not shame.
✅ Carry naloxone (Narcan) and learn the signs of overdose: pinpoint pupils, limp body, slowed or stopped breathing, or choking sounds.
✅ Assume risk. Never trust pills, powders, or substances not prescribed to you – even one can be fatal.
✅ Talk openly. Have kind, judgement-free conversations with loved ones about the risks of fentanyl, especially in unprescribed pills.

If you or someone you know is struggling with substance use or addiction, you’re not alone, and help is available.

⚠️ In an emergency, call 911 immediately.
⚠️ Need support or treatment? Call the SAMHSA helpline at 1-800-662-HELP (4357) or visit FindTreatment.go.
⚠️ If you or someone you know is experiencing emotional distress, call or text 988 to reach the Su***de & Crisis Lifeline (available 24/7).

Let’s use Fentanyl Awareness & Education Day to protect lives, spread facts, and strengthen our community.

Insurance claim denied?

It can be frustrating when you believe your claim should have been covered, but insurance companies can deny claims for many reasons, including insufficient information or filing errors.

If your claim has been denied, don't give up! You have the right to appeal the decision. A well-written letter from an experienced attorney can get the attention of the insurance company's legal team and help identify potential problems or gray areas that can benefit you.

Here's why having a lawyer in your corner is a game-changer:

1️⃣ They are experts at calling out insurance companies on their games, especially when they are acting in bad faith.
2️⃣ They can review all documents related to the claim and pinpoint any problem areas on behalf of their client.
3️⃣ They will work with your insurer on a settlement amount that is fair for all parties involved
4️⃣ They can review any paperwork related to the denial of your claim and will help explain complex legalese in plain language

At Frankl Kominsky Injury Lawyers, we have the resources and knowledge to help you appeal your denied claim. Reach out today if your insurance company is giving you the runaround. We'll dive into your policy, gather evidence, and build a rock-solid case to appeal that denied claim.

It’s back-to-school season in Florida, which means busy roads, flashing school zone lights, and lots of little feet at crosswalks. 🚌🍎

Staying alert isn’t just a rule of the road – it’s a responsibility we all share to keep kids safe.

Whether you are driving, biking, or walking, here are some key reminders to help everyone get to school and back home safely.

⚠️ Safety Tips for Drivers:

1️⃣ Slow down in school zones – fines and penalties are steep.
2️⃣ Stop for school buses – never pass when red lights are flashing and the stop arm is extended.
3️⃣ Stay hands-free – no handheld devices in school zones.
4️⃣ Watch for crossing guards & students – always stop when directed.
5️⃣ Be patient at pick-ups and drop-offs – use designated areas and stay alert.

⚠️ Safety Tips for Pedestrians (Students & Parents):

1️⃣ Always use crosswalks and follow safe school routes.
2️⃣ Practice bus stop safety – wait several steps back from the curb, never walk behind a bus, and only cross when the driver signals.
3️⃣ Be visible – wear bright or reflective clothing.
4️⃣ Avoid distractions – keep phones and headphones away near traffic.

Let’s work together to keep our kids safe this school year. 💛

If you or a loved one is ever injured in a school zone collision or bus-related accident, Frankl Kominsky Injury Lawyers are here for you 24/7. Call 855-800-8000 for a free consultation.

Car accidents happen in an instant but can leave lasting consequences for those involved. From minor fender benders to catastrophic collisions, it’s crucial to recognize the common types of accidents and their potential risks. Here's what you need to know:

💥 Low-Speed Accidents
Usually occur at stop signs, red lights, parking lots, and neighborhoods. Even at under 10 mph, injuries like whiplash and property damage are common.

💥 Single-Vehicle Crashes
Caused by poor road design, defective vehicles, or lack of maintenance. These crashes often stem from factors beyond the driver's control.

💥 Multi-Vehicle Collisions
Frequent in busy intersections and highways, these complex accidents may involve multiple parties sharing responsibility.

💥 Hit-and-Run Accidents
Florida law has severe penalties for leaving an accident scene. If you’re a victim, document as much detail about the driver and vehicle as possible.

💥 Rear-End Collisions
Usually the fault of the rear driver, but exceptions include sudden braking or faulty brake lights from the lead vehicle.

💥 Side-Swipe Collisions
Often caused by drivers failing to check blind spots. Always use signals and check your surroundings.

💥 Head-On Collisions
These catastrophic crashes often result in severe injuries or fatalities due to the high force of impact.

💥 T-Bone/Side-Impact Crashes
Happen at intersections when drivers run red lights or fail to yield. They often result in serious injuries and significant vehicle damage.

If you are involved in any of these accidents, it’s essential to protect your rights and seek legal guidance. A licensed attorney can help you pursue compensation for:

✔ Medical bills
✔ Lost wages
✔ Property damage
✔ Pain and suffering
✔ Other expenses resulting from the accident

Do pedestrians always have the right-of-way in Florida? 🚶🚗

Not always! That's one of the biggest misconceptions we see after pedestrian accidents.

Many pedestrians believe stepping into a crosswalk automatically gives them the right-of-way. At the same time, many drivers believe pedestrians must wait until every lane is clear before crossing.

The truth is, both drivers and pedestrians have responsibilities under Florida law.

Here's what you should know:

✅ Drivers must yield to pedestrians crossing in marked and many unmarked crosswalks and exercise due care to avoid hitting anyone on foot.

✅ Pedestrians don't have unlimited right-of-way. Crossing outside a marked or unmarked crosswalk, or crossing against a signal, can affect who is at fault.

✅ Unmarked crosswalks still count. Even if there aren't painted lines, many intersections legally qualify as crosswalks.

✅ Drivers still have a duty of care. Even if a pedestrian makes a mistake, drivers must take reasonable steps to avoid a collision whenever possible.

✅ Fault isn't always all or nothing. Under Florida's modified comparative negligence law, an injured pedestrian may still recover compensation if they are 50% or less at fault, though any recovery is reduced by their percentage of fault.

Pedestrian accident cases are often far more complex than they appear. Determining who had the right-of-way depends on where the crossing occurred, traffic signals, road conditions, visibility, and the actions of everyone involved.

If you or someone you love has been injured in a pedestrian accident, don't make assumptions about your rights. Let our experienced legal team review your case and explain your options.
