Recently, ELPO Law attorney Aaron Smith participated in an en banc hearing before the U.S. Sixth Circuit Court of Appeals. ⚖️

Why is this a big deal?

1️⃣ Power in Numbers: Less than 1% of federal appeals are heard en banc. Instead of 3 judges, the entire court of judges sits together to decide the case. This happens when a legal issue is so large, or the lower court rules are so confusing that the whole court needs to step in to straighten it out.

2️⃣ Fixing Confusing Laws: The case addresses a major legal knot—the fact that courts currently use completely different standards to judge jail safety claims depending on whether an inmate is convicted or awaiting trial—creating a tricky and inconsistent environment inside the same jail facilities.

3️⃣ Seeking Consistency: We are pushing for a single, clear constitutional standard. When the law is consistent, it's easier to follow, easier to enforce, and better at protecting everyone's constitutional rights.
