Folks, today is Law Day, and I'm excited for today's event in Boston, coordinated nationwide, for lawyers to attend and hear about the crucial importance of the rule of law for human rights, for justice, for a fair economy, for democracy, and for stability. The judicial system and the idea of independent judges fairly interpreting and ruling on the law is under attack by the Trump administration. Ordinarily, Law Day means speeches and earnest discussion about the rule of law. This year – that is timely and much needed. America needs the rule of law, not arbitrary and capricious rule by any autocrat.



I'll be attending at Boston Common (one of the first radical ideas from Massachusetts, and the oldest city park in the US, and also the former shoreline of Boston) where I'm eager to re-take my oaths to the US Constitution and the Massachusetts Constitution. Attention creators! (And for anyone creating expressive work) The has clarified their guidance on works (e.g., text, art, audio, video) generated with or outputs. The rule remains that humans must be authors of work in order to register in them. If the work is made only by prompt – with no modification – it lacks "human authorship": it can't be registered. You can download the Fed. Register publication as a PDF: https://buff.ly/40BuOd6.

Human input, in a creative work, might be arranging AI-generated material into a specific sequence, or editing it. The amount of input or editing required to make a work registrable isn't set out in a formula: the Office's prior guidance will likely apply. The Office says "In these cases, copyright will only protect the human-authored aspects of the work, which are ‘‘independent of’’ and do ‘‘not affect’’ the copyright status of the AI-generated material itself."

An important note for anyone trying to register work made with or output: AI/ML output must be disclosed in a copyright registration application. If not disclosed, the application can be denied, or a registration can be cancelled. If a registration has been issued, or an application is pending, the registrant/applicant should correct the record.
