If you’re a bartender or server in Massachusetts, the law now makes it clear: your employer must pay you $15 per hour for side work – this includes tasks such as rolling silverware, topping off ketchup bottles or cleaning your area. They cannot pay you the lower tipped rate ($6.75/hour) for that time, even if the service rate plus your tips equals or exceeds the minimum wage of $15 per hour. Know Your Rights: PFML and Retaliation Protections in Massachusetts

Under Massachusetts’ Paid Family and Medical Leave (PFML) law, employees are entitled to paid time off for qualifying family or medical reasons. But PFML is more than just leave — it’s legal protection.

📌 What you should know:
PFML protects you from retaliation and discrimination for taking or requesting leave. This means your employer cannot punish, fire, demote or otherwise treat you unfairly for exercising your PFML rights.

🕒 The Six-Month Rule
If adverse action is taken against you within six months of returning from PFML, the law presumes retaliation — and the burden is on your employer to prove otherwise.

A recent U.S. District Court ruling in Turgut v. Hitachi Rail STS USA, Inc. reinforces the strict obligations of the Massachusetts Wage Act. The court ruled that employees working five-day weeks must be paid within six days of the end of the pay period—rejecting the employer’s argument for a seven-day deadline.

Attorney Raven Moeslinger noted, “The holding gives meaning to both the six-day and seven-day payment provisions.” This decision clarifies an often-misunderstood area of wage law, emphasizing that compliance matters down to the last day.
