He represents and defends individuals facing criminal charges in Massachusetts’ District and Superior Courts as well as in Federal Court. He earned his Bachelor of Arts from the University of Massachusetts Amherst in 2013 and his Juris Doctor from Suffolk University Law School in 2016. Hampden County Superior Court - Client originally charged with first degree murder resolved case after pleading to one count of manslaughter, carrying a fi***rm without a license and possession of am******on without an FID card. Client received sentence of 5-7 years despite facing a maximum sentence of 20 years for manslaughter, 5 years for the fi***rm charge and 2 years for the am******on charge. Attorney Berquist successfully chipped away at critical portions of the Commonwealth’s case and persuaded a Superior Court judge to impose a lesser sentence. With credit and good time the client will be eligible for release in approximately 2 1/2 - 3 years.

Sexual Abuse Finding REVERSED! Attorney Berquist successfully gets sustained finding of sexual abuse of a child overturned. After a 2 day evidentiary hearing, a DCF hearing officer agreed with Attorney Berquist that the Department’s decision to support the allegation of sexual abuse violated DCF’s own policies and regulations and no reasonable basis existed to conclude the sexual abuse occurred. The client was subject to an unfair and biased investigation by DCF and the investigation was flawed from the start as uncovered during two hours of cross examination.

Motion to Dismiss ALLOWED! Attorney Berquist successfully persuades Worcester County judge to dismiss all charges against client facing allegations of breaking and entering to commit a felony, resisting arrest and felony vandalism. After successfully obtaining court orders for the Department of Homeland Security, who assisted local police in the case, to comply with discovery rules and seeking to enforce those orders, the federal government elected not to comply and as a result the case was dismissed.

Violation of probation WITHDRAWN! Attorney Berquist successfully gets Worcester County judge to order probation violation withdrawn. Client on probation was accused of picking up a new offense. Since Attorney Berquist was successful in having client’s arraignment postponed and the new case eventually dismissed, the probation department was ordered to withdraw its allegation of a violation.

Case DISMISSED prior to arraignment! Attorney Berquist successfully persuades Middlesex District Attorney’s Office to enter a Nolle Prosequi (dismissal) of all charges before client was arraigned. Client was facing allegations of possession of a sawed off sh***un (a life felony), possession of a large capacity fi***rm, possession of a large capacity feeding device, two counts of possession of a fi***rm without an FID card, and possession of am******on without an FID card. Ordinarily this case would have been arraigned and then indicted to the Superior Court since the District Court would not have had jurisdiction to proceed with some of the charges.

Case DISMISSED! A Middlesex County judge allowed Attorney Berquist’s motion to dismiss after he successfully argued the prosecution should not be allowed to obtain a bench warrant for a material witness. The judge denied the prosecutor’s request and allowed Attorney Berquist’s motion to dismiss for client accused of one count of threat to commit a crime (murder).

Charges DISMISSED! After Attorney Berquist filed a motion to obtain undercover social media account information utilized by the police to obtain evidence against his client, the District Attorney’s office elected to file a “Nolle Prosequi” dismissing all charges before a hearing in Worcester Superior Court. The client was charged with possessing a sawed off sh***un - second offense, a life felony, possessing am******on without an FID card, and improper storage of a fi***rm.
