JURY VERDICT: NOT GUILTY! After a one day jury trial, Attorney Berquist persuades a Worcester County jury to acquit his client of felony assault and battery with a dangerous weapon (boiling water) as well as the lesser included offense of assault and battery. Jury deliberations lasted approximately one hour.

Motion to Suppress Identification ALLOWED! Attorney Berquist successfully persuades Hampden County Superior Court judge to suppress all identifications made by an eyewitness in a homicide case. The judge found the police were improperly suggestive with the witness during the identification procedures which tainted the reliability of all identifications made by the witness.

Motion to Suppress Evidence ALLOWED! After vigorous cross examination and successful arguments by Attorney Berquist, a Plymouth County judge has found that the warrantless entry by Bridgewater police into client’s room and closet where a firearm and ammunition were seized was unlawful. Further, the Court found because the police obtained all statements from the client without providing the required Miranda rights, the interrogation was also unconstitutional. Client has been charged with unlawful possession of a firearm, unlawful possession of ammunition, and improper storage of a firearm. As a result of this ruling, all evidence obtained as a result of the unconstitutional search, seizure, and interrogation by the police has been suppressed and all charges are expected to be dismissed.

Application for criminal charge DENIED! After hearing, an Essex County Clerk-Magistrate sided with Attorney Berquist that no probable cause existed to charge his client with violating a restraining order and denied the police department’s application for a criminal complaint.

Sexual Abuse Finding REVERSED! Attorney Berquist successfully gets sustained finding of sexual abuse of a child overturned. After a 2 day evidentiary hearing, a DCF hearing officer agreed with Attorney Berquist that the Department’s decision to support the allegation of sexual abuse violated DCF’s own policies and regulations and there was no reasonable basis existed to conclude the sexual abuse occurred. The client was subject to an unfair and biased investigation by DCF and the investigator made material misrepresentations which were uncovered during cross examination at the hearing.

Motion to Suppress Evidence ALLOWED and indictments DISMISSED! An Essex County Superior Court judge allowed a motion to suppress evidence seized pursuant to a search warrant brought by Attorney Matt Berquist and Attorney Hank Brennan. As a result the indictments charging client with felony conspiracy to violate the drug laws and trafficking in 200 grams or more of methamphetamine, which carries a 12 year mandatory minimum sentence, were dismissed after the prosecution elected not to appeal.

JURY VERDICT: NOT GUILTY! After a one day trial, a Worcester County jury acquitted client of OUI Liquor. Attorney Berquist successfully argued for the judge to enter a finding of not guilty on the charge of reckless operation of a motor vehicle after the prosecution rested its case and before the jury began deliberating. The judge also found the client not responsible for speeding. The charge of disorderly conduct was dismissed months before after Attorney Berquist won a motion to dismiss for lack of probable cause on that charge. Jury deliberations lasted under 15 minutes.
