The U.S. Securities and Exchange Commission just published a list of the six mistakes it keeps finding in advisers' annual compliance reviews.

Some are what you'd expect. Others are the kind a firm with solid policies still makes: a review report your own procedures require that nobody ever wrote, or a corrective action reported as complete and never implemented.
Yelitza Montesino walks through all six from the Division of Examinations' September 14 Risk Alert and what examiners flagged in each.

You close on a house. A month later you find out the deck was built without permits, or that there's faulty plumbing behind a wall no inspector could have seen.

Massachusetts is a "buyer beware" state, so a seller has no general duty to volunteer what's wrong with a property. That isn't the end of the story, though.

In his latest article, Dave Glod walks through when a buyer actually has a claim. Worth a read if you're buying, selling, or advising someone who is: https://bit.ly/4xQSOcp

Great day connecting with fellow professionals for a fantastic cause! ⛳️🎾

Attorneys Danielle Justo, Anthony McGuinness, and Arvid von Taube from Rich May, P.C. recently attended the ProVisors New England Day of Outdoor Networking. Tony took to the links for golf, Arvid hit the pickleball courts, and the team gathered together for the cocktail reception and awards ceremony.

In addition to building meaningful professional connections, the event raised funds to benefit The First Tee of Massachusetts, an impactful organization dedicated to helping young people build character, confidence, and essential life skills through the game of golf.

Tom Bilodeau is marking 30 years at Rich May this year, and we couldn't let it go by without a proper congratulations.

Tom is a Managing Director and shareholder and co-chairs our Investment Management and Private Funds group. Investment advisers and fund managers rely on him to set up and run their businesses, and private companies have trusted him with their M&A and financing deals.

He's been named a New England Super Lawyer every year since 2008 and a Boston Magazine Top Lawyer since 2021. He also serves on the board of Medicines for Humanity, a nonprofit that helps children in need around the world. When he's not at the office, there's a good chance he's fly fishing for striped bass in Boston Harbor.

Congratulations, Tom, and thank you: https://bit.ly/4hAI0dw

The Supreme Judicial Court’s decision in Town of Nahant v. Northeastern University is an important ruling for Massachusetts municipalities seeking to preserve open space, habitat, and natural resources in the face of proposed development.

The Court confirmed that conservation is a valid public purpose for eminent domain and clarified that a conservation taking is not improper simply because it responds to a threatened development project. For municipalities, the decision underscores the value of long-term planning, documented conservation priorities, and a clear record of public purpose.

In Rich May’s latest insight, Racer examines the SJC’s ruling, the key distinction from Pheasant Ridge, and what the decision means for communities working to protect environmentally significant land for future generations.

A strong legal community is built through connection, collaboration, and the opportunity to bring different perspectives together.

Rich May attorneys Diana M. Alsabe, Joseph Y. Wang, and James B. Heffernan recently joined colleagues at the annual Affinity Bar Mixer, hosted by the South Asian Bar Association of Greater Boston (SABA GB) in partnership with the Asian American Lawyers Association of Massachusetts, Massachusetts LGBTQ Bar Association, and Arab American Bar Association of Massachusetts, among others.

The evening brought together attorneys from across Greater Boston to strengthen professional relationships, build community, and support the important networks these organizations foster throughout the legal profession.

Thank you to SABA GB and the partnering affinity bar associations for bringing the community together for another meaningful event.

A change of scenery and a chance to enjoy summer together.

The Rich May team recently traded the office for the water for our annual summer outing aboard a Boston tiki boat. It was a great opportunity to step away from our desks, spend time together, and enjoy the city from a different perspective.

We value the strong relationships we build with our clients and within our community, but just as important are the relationships we build with one another. Thank you to everyone who joined us for a memorable afternoon on the harbor.
