Thanks IP for including our thoughts in this article about litigation funding disclosures. Litigation funding is a way of leveling the playing field so that inventors and small companies can enforce their patent rights against large companies. Without any evidence of foul play, courts and legislators are questioning it and making it harder for these smaller players to assert their rights.

Thanks for including our thoughts about WDTX's order distributing cases filed in Waco to other WDTX judges. As we said: "We filed there because we thought Waco’s local patent rules were very fair to both sides. Now with this new order, there’s a one in 12 chance of getting Waco. It seems to completely undercut a lot of reasons for filing there."

Eight years ago today, Blackbird was founded to help inventors realize value from their patents. Twelve days before, the Supreme Court decided Alice. IPRs were crushing inventors. Over the past eight years, neither the Supreme Court nor Congress did anything to help. Yesterday, the Supreme Court did nothing again. But, we will keep fighting for inventors.

First, TC Heartland made it hard for inventors to sue in EDTX. Now, CAFC "convenience" mandamus orders are stopping inventors from suing in WDTX. As we said in this article, is this a convenience issue or really just the defendants gaming the system to get into a court that’s more favourable to them?

Thanks for including our views in this article about denials. Petitioners have figured out that agreeing to stipulate not to raise invalidity arguments in district court that were raised in an IPR is, in fact, essentially the same as the statutory estoppel. In other words, it's an easy way to get around Fintiv and have their IPR instituted.

Fewer patent challenges are being turned away under a rule that allows an administrative tribunal to take parallel litigation into account, as the agency faces calls to revisit the rule and lawyers adjust their approaches.
