READ: Christina K. McGlosson’s blog post, CFTC Finalizes Whistleblower Awards Rule, which addresses the Commission's final rule, establishing a 30% presumption for whistleblower awards of $5 million or less, and projected benefits for whistleblowers.

The proposed rule, which takes effect on October 11, 2026, is modeled on the ’s rule 21F-6(c). For whistleblowers, it may increase smaller awards and incentivize more whistleblowers to come forward. For the , it should improve the Commission’s efficiency, transparency, and predictability of whistleblower award claims’ processing.

“I am encouraged by this development. The 30% presumption may likely increase most whistleblower awards, while saving the CFTC considerable time. As markets and trading technologies emerge, whistleblowers play a more critical role in ensuring the integrity of our commodities, futures, and derivatives markets,” said Christina McGlosson, Special Counsel: Dodd Frank Whistleblower Practice and a former director of the Commodity Futures Trading Commission Whistleblower Office.

The four companies controlling roughly 98% of the frozen potato product market must face consumers' accusations that they shared competitively sensitive information and coordinated other efforts to carry out an illegal scheme, an Illinois federal judge has ruled.

The judge trimmed only some state law claims from the proposed classes' consolidated complaint and said Thursday the consumers have plausibly outlined an illegal conspiracy through which Lamb Weston Holdings Inc., McCain Foods, J.R. Simplot Co. and Cavendish Farms Ltd. manipulated hash brown, tater tot and other frozen potato product prices in violation of the Sherman Act.

The indirect purchasing consumers are represented by Cohen Milstein Sellers & Toll PLLC and Hagens Berman Sobol Shapiro LLP.

BREAKING: A memo from U.S. Environmental Protection Agency ( ) leadership to its Regional Water Division directors withdraws guidance that encouraged states and wastewater utilities to use existing Clean Water Act authorities to prevent pollution from entering waterways and drinking water systems.

The memo, dated August 11, was signed by EPA Assistant Administrator for the Office of Water, Jessica Kramer. The withdrawn guidance addressed in the memo was removed from EPA’s website, but a copy of it can be found on Food Safety Magazine.

“It is deeply troubling to see the EPA continue to weaken fundamental hashtag protections that safeguard public health, property, and the environment. States and wastewater utilities serve as critical partners in protecting drinking water systems, yet these actions signal a troubling shift in the agency’s priorities. When essential and environmental protections are diminished in favor of industry interests, the EPA risks undermining its core mission,” said Ted Leopold, a partner at Cohen Milstein and co-lead counsel in Nix, et al. v. Chemours, et al, a large PFAS brought on behalf of North Carolina residents. “I remain hopeful that Congress will exercise its oversight authority to restore the agency’s focus and reinstate these fundamental safeguards that communities across the country depend on for clean, safe water.”

BREAKING: Evidence is mounting that the began winding down existing class cases even before initiating rulemaking that would eliminate such complaints entirely.

A federal employee union alleged that the Equal Employment Opportunity Commission quietly issued a “suspension directive” to pause cases as early as December 2025. The EEOC also abruptly decertified the classes in two longstanding disability and racial discrimination cases, and overturned a ruling in a third, bringing them to a close.

“I don’t think these are just coincidences,” said Joe Sellers, founder and partner at plaintiff’s firm Cohen Milstein Sellers & Toll LLP, which represents the union. “They are trying to get out of the business of engaging in, challenging, and even providing a forum for challenging systemic discrimination.”

Administrative class complaints have long been regarded as an essential tool to address systemic discrimination in the federal workforce. Attorneys for government workers are concerned that their elimination will push workers to the federal courts, where litigation is costly and caseloads are heavy.
