📢PM-602-0192/4 Update.

In Dorcas v USCIS, US District Court John J. McConnell, Jr. has issued a 135-page positive order that apparently lifts the USCIS holds.

However, it is almost certain this order will be appealed as it is contrary to the Trump administration's interpretation of Trump v CASA (on universal injunctions).

During an appeal, however, the order still must be implemented. The only way the government can prevent implementing the order while the appeal is pending is if a court grants a "stay" of the order.

So we predict the government will be filing a motion to stay the implementation of the order in the coming weeks (first with the District Court, and if that's denied, with the Circuit Court).

FAQ: I'm impacted by USCIS's PM-602-0192/3/4 benefit holds and I've done a congressional inquiry and received a boilerplate response. Is that all I can do with this route?

Answer: No! You are only getting started! Now is the time to ask the constiutent services person to raise the following questions with the congressperson:

1) To what extent are the USCIS benefit holds tied to the creation of a new USCIS vetting center in Atlanta, as they have suggested in other litigation?
2) Has Congress approved funding for this new Atlanta vetting center?
3) Are the USCIS holds going to remain in place until the Atlanta vetting center exists?

And for the doctors out there:
4) How do we know the lifting of the hold for medical physicians is real when we don't see medical physicians getting USCIS benefits?
5) How are medical physicians defined for the purposes of this exception? What types of applications does it apply to?
