In 1978, Congress passed the Bankruptcy Code, replacing the old 1898 Bankruptcy Act. The Code was revolutionary in its thinking and its processes, and has helped millions of Americans in the 40+ years since its enactment. The main bankruptcy chapter is Chapter 7, which is a liquidation of non-exempt assets and the granting of a judicial discharge to the Debtors. But there are are now separate chapters for small businesses, farmers and ranchers, and larger operations, all of which are designed to help people restructure their debts over a period of time. They all differ somewhat.
