Today, on Veterans Day, we pause to honor and thank all who have served our country. At Atkins Law Offices, we hold a deep appreciation for our veterans—not only for their sacrifice and service but for the values they continue to bring to our communities every day.

We are especially proud to celebrate one of our own: Tess Berish, our Office Manager and a proud veteran of the United States Air Force. Tess has been with Atkins Law Offices since our inception in 2020 and has been absolutely instrumental in shaping who we are today. Their leadership has advanced our processes with remarkable efficiency and accuracy, and their commitment to innovation has propelled us to adopt the most advanced technology—including cutting-edge AI tools—to better serve our clients.

Tess brings the same discipline, creativity, and service mindset from their time in the Air Force to everything they do. Born and raised near Scranton, Pennsylvania, Tess went on to earn a Bachelor of Science in Media Communications from Full Sail University, combining their technical expertise and creative talent to elevate every project they touch.

Outside of the office, Tess continues to embody a spirit of service—volunteering with Wild Hearts Idaho, where they create video content to empower young women through outdoor adventure, and with the Boise Bicycle Project, where they help make cycling more accessible for everyone.

Facing litigation in Idaho can feel overwhelming, but a strategic tool known as Idaho Rule of Civil Procedure 68 — the “Offer of Judgment” — can provide leverage. Under IRCP 68, a defending party can serve a formal settlement offer at least 14 days before trial. If the offer is accepted within 14 days, judgment is entered and the case ends. If the offer is rejected and the offeree later obtains a less favorable judgment at trial, they may have to pay the offeror’s post‑offer costs and miss out on their own attorney fees. Rule 68 encourages realistic settlement discussions, helps defendants limit risk, and forces plaintiffs to evaluate their case carefully.
