Foreclosure Abuse Prevention Act (FAPA) bombshell opinion dropped by the Supreme Court, Queens County (Sampson, J.), in the matter of Ditech v Naidu, which was one of the four original consolidated appeals underlying the Court of Appeals' Freedom v Engel opinion (abrogated in part by FAPA).

This Naidu opinion addresses most, if not all, of the FAPA related contentions being hurled about by litigants throughout New York's trial and intermediate appellate courts.
