Are you or your business prepared for the FTC's new non-compete rule, which was set to go into effect and ban non-compete agreements nationwide on September 4, 2024. However, on August 20, 2024, in Ryan LLC v. Federal Trade Commission, the U.S. federal court in the Northern District of Texas set aside the FTC’s non-compete rule and ordered that it cannot be enforced. As a result, the FTC cannot enforce the new non-compete rule against employers nationwide for the time being, but the ruling will likely be appealed to the U.S. Court of Appeals for the 5th Circuit (although there is other litigation pending in other jurisdictions).
