Is a multi-billion-dollar AI valuation built on unlicensed creative works? 🎧⚖️

Major music publishers are drawing a hard line against generative AI scraping. In the Northern District of California (Case No. 5:26-cv-02334-EKL), BMG Rights Management has officially become the third major music company to file a standalone copyright infringement lawsuit against Anthropic PBC.

Instead of joining the existing publisher coalition, Bertelsmann-owned BMG chose an independent path to pursue its own damages architecture and forensic training-data accounting for Claude's ingestion of copyrighted compositions and lyrics.

With three simultaneous federal music copyright cases now active against Anthropic in N.D. Cal., the core legal question remains the same: Is training a large language model on protected commercial lyrics protected fair use, or direct statutory infringement?

As tech developers lean heavily on fair use defenses, rights holders are demanding accountability at the data-ingestion level.
