115 in a 65 = dismissed.

96 in a 55 = dismissed.

66 in a 45 = dismissed

Lawyer going 54 in a 45 = dismissed

4 for 4. All on technicalities (not cases where the cop did not show up to trial).

Let’s roll.

Update from The Law Office of Edward J. Kone - It’s Because we Care

I have handled 7 traffic tickets this week - all moving infractions - and I have got them all Dismissed. Only 1 of the dismissals involved the police officer not appearing. All of these cases are prepped and personally handled by me. It is all about preparation, knowing the law., knowing the courtroom, knowing the players and having the will to win. Let’s roll.

As a veteran criminal defense attorney for over 36 years who watched what went on at the Hearing today on Trump’s Motion to Disqualify Atlanta district attorney Fani Willis, I must conclude that she should be removed from the case forthwith, she should be investigated by the Georgia Bar for her courtroom antics and dishonesty, and the Georgia Attorney General should investigate her for Perjury.

A prosecutor’s first obligation is to seek justice and he or she must also scrupulously follow the rules and the law. Contrary to these legal obligations, Willis hired her lover Nathan Wade, a person with no prosecutorial experience and little if any criminal defense experience, to prosecute Donald Trump. Wade has been paid in excess of 600k in fees to date. A very credible witness testified today that the Willis/Wade romance began prior to his being hired contrary to the sworn testimony given by Willis and Wade. Willis and Wade were grilled about all of the expensive trips they took after she hired him and they both testified that she paid him back in cash. Yeah right. However this is all undocumented - no withdrawal slips, no deposit slips and not one iota of corroborating testimony. Go figure.

On the witness stand, Willis, an officer of the court, and the person in charge of all criminal prosecutions in the county, showed blatant contempt for the court. She lied, dodged questions, ignored questions, refused to answer questions and was shouting at times. At one point, Judge Mcafee warned Willis that he would have to strike her testimony from the record if she refused to answer the questions as asked. The judge then called a 5 minute recess and when the Hearing resumed, the Judge said: “You all know what professionalism looks like; we all know what decorum looks like.”

Willis should disqualify herself from the case and resign from office immediately. She is obligated to adhere to the highest standards of law but rather she turned the Hearing into a circus with her lies, her outbursts, her dodging, her weaving, and her total lack of decorum and professionalism. She knows the rules yet abused and violated them. She cannot justifiably expect any witness in her future prosecutions to be honest, direct, and respectful to the court when she herself did not live up to those standards as a witness in court. If there are 2 sets of rules, there are no rules. She is undermining our entire judicial system by knowingly and willingly abusing it. Disqualify her now, file a bar complaint against her now, and begin a perjury investigation against her now.

2 cases for friends concluded today:

1) My buddy’s son (great kid) was arrested for a Resisting Arrest without Violence Misdemeanor charge in the Keys a few months ago. I was all over it from day one and it was Nolle Prossed (dismissed) today.

2) Dr. friend of mine got an HOV Lane violation in Palm Beach County. Instead of farming it out to a coverage attorney, I handle these myself and at the trial today I got it dismissed. The trooper was there (they usually are) but I used my experience to get it completely thrown out.

2 clear cut wins.

Just a crazy day today but crazy good at the Law Office of Edward Kone.

Started with a plea bargain for a female client charged with Battery on a Law Enforcement Officer (3rd degree felony) - she allegedly bit the officer but I was able to get her a sweet deal involving a short term of probation and she will be eligible to petition for a complete record sealing if and when she successfully completes probation.

Then I went from that live hearing into a zoom hearing to represent a client accused of going 112 miles per hour in a 65. Despite my client’s bad driving record, I was somehow able to avoid the imposition of a driver license suspension and the imposition of 4 points.

I then jumped onto 2 more zoom hearings and got my client’s careless driving accident ticket (she hit a guard rail) thrown out because the narrative on the ticket was insufficient. I then got another client’s speeding ticket thrown out due to insufficient documentation.

And, late this afternoon I was able to secure a very favorable plea agreement in a DUI accident case. I got the charge reduced to Reckless Driving, Adjudication was withheld thus no conviction, there was no jail time imposed, no driver license suspension, and no ignition interlock.

And I capped off the day with some great news regarding a 17 year old who recently paid off a speeding ticket and a careless driving ticket prior to retaining me. This all resulted in 7 points being assessed against her driver license and her regular license being changed to a business purposes license. However, once retained, I filed 2 motions to vacate her pleas which were granted, I resolved the cases with withheld adjudications which means no points, and my client’s driver license was fully reinstated just today. Gone are the points and gone is the permit.

Tomorrow looks like it is going to be just as crazy.

We are just hammering away at the Law Office of Edward Kone this week.

Cop from out of state - arrested and charged with 3 misdemeanors which I got nolle prossed (dismissed) in less than 2 weeks. There is no greater privilege for me than to represent the men and women in blue and their family members.

Misdemeanor warrant - got the warrant lifted and the charge dropped within 48 hours of being retained.

Traffic citations - got 7 outright dismissals so far this week.

Edward J. Kone, P.A. Update.

This month marks the beginning of my 36th year as a practicing lawyer in the State of Florida almost exclusively in the areas of criminal law, personal injury, and traffic law. Such experience is invaluable especially when combined with hard work, preparation, and a burning desire to win. I am fortunate enough to have marked my 36th anniversary with some huge victories over the last 2 weeks.

Case 1: GRAND THEFT (3rd Degree Felony) - client lives out of state but had an 11 year old Florida arrest warrant. I dealt with 2 different prosecutors over 2 months, ultimately convinced the prosecution there were Statute of Limitations issues (provided strong case law) and proof issues, and ultimately got the warrant lifted and the case Nolle Prossed (dismissed) without my client even having to surrender himself or go to Court.

Case 2: VIOLATION OF DUI PROBATION - client came to me because he had a no bond warrant issued for his arrest over a year ago for failure to complete the terms of his probation. We investigated the situation and I dealt extensively with probation and the prosecutor. End result - I got the warrant lifted and probation terminated with no penalties whatsoever.

Case 3: DUI - client was allegedly under the influence of alcohol and drugs, he allegedly failed roadside sobriety tasks, and he refused a urine test. Not only did I win the Formal Review Hearing thus avoiding a 1 year suspension of his license for the refusal but I also convinced the state attorney’s office to not even file the case. First inning grand slam.

Case 4: TEMPORARY RESTRAINING ORDER ENTERED AGAINST MY CLIENT FOR DATING VIOLENCE - client came to me with the temporary restraining order that was issued against him, jumped on this right away, proved to opposing counsel that the alleged victim had multiple communications with my client after the alleged incident, and I got opposing counsel to dismiss the case on the eve of Trial thus lifting the temporary restraining order.

Case 5: PETITIONS FOR RESTRAINING ORDER TO BE ENTERED AGAINST MY CLIENT FOR STALKING A HUSBAND AND WIFE - after several months of beating the other attorney to the punch and after getting the Judge to rule in our favor on a key pre-trial issue, I got the other side to dismiss both Petitions.

Case 6: CLIENT INVOLVED IN ACCIDENT WITH TRUCK - my 23 year old client never went to the hospital, he only treated with a chiropractor for soft tissue injuries and it was for a mere 10 weeks, and the cervical MRI results came back negative. I somehow settled the case for 30k.

What a week and it’s only Tuesday. Got a strangulation case nolle prossed (dismissed) this morning after many months of doing battle. Thoroughly reviewing the police reports and videotapes, taking 3 very focused depositions and lots of persuading of the prosecutor resulted in a grand slam for my client.

Yesterday I got a great deal on a DUI case. It was a second offense, there were allegations of fleeing, my client was alleged to have been driving recklessly and there was an accident. I filed 2 Motions to Suppress one alleging that the police officer illegally detained/arrested my client outside of his jurisdiction. Got a call from the prosecutor just a couple of hours before the Hearing and resolved the case as follows: DUI dropped, withheld adjudication on Reckless Driving charge (no conviction), and a short period of probation with no ignition interlock nor driver license suspension. The original plea offer involved a dui conviction, jail time, house arrest and a 12 month license suspension.

These cases involve lots of hard work and no how.

Hit the Trifecta yesterday on 3 different traffic ticket charges in 3 different counties.

Palm Beach - speeding ticket 82 in a 50 - totally dismissed.

Broward - tint ticket - totally dismissed.

Dade red light camera ticket - totally dismissed.

3 for 3 = hat trick

Lots of winning going on over the last 48 hours at the Law Office of Edward Kone.

Case #1
Long time client involved in accident, not a lot of medical bills and no injections nor surgery. Settled for 35k within 8 months of the accident which is warp speed.

Case #2
Business owner charged with giving false information to police - a 1st degree misdemeanor. Got case nolle prossed (dismissed) within 2 weeks of being hired.

Case #3
Client charged with violation of right of way for an accident with a motorcyclist resulting in injury. There were more than 25 cases on the docket and I was the only attorney to go to an actual trial. 2 civilian witnesses and the police officer testified against my client but I got a Not Guilty verdict.

Case #4
The son of a buddy of mine got a speeding ticket for going 50 in a 30. Got police officer to dismiss the citation. Knowing how to deal with police officers is not something you learn in law school or learn from reading books or watching phony tv - it is something that comes from battle tested experience.

Case #5
Client got a chintzy ticket down at Miami International Airport for stopping his car in a prohibited area. Got ticket thrown out at pre-trial conference based on due process argument that the ticket did not specify what my client did wrong.

To quote the late great Al Davis - owner of the NFL’s Raiders - “ just win baby”.
