PKG Gets Final Approval of Nearly $2 Million TPCA Class Action Settlement!

We are proud to announce that the Southern District of Texas has granted final approval of a $1,994,123 settlement in the Telephone Consumer Protection Act class action against Colony Ridge Development, LLC. Led by partners Alex Kruzyk and Bryan Giribaldo, Pardell, Kruzyk & Giribaldo, PLLC, served as Class Counsel to secure this landmark result for consumers.

This settlement stands out for its exceptional recovery: after all deductions, eligible claimants are expected to receive over $3,700 each. This is one of the highest per-claimant recoveries ever achieved in a TCPA class action!

We are honored to have represented the Class Representative and all settlement class members in achieving this significant result.

PKG Receives Court-Approval for $260,000 Settlement in FLSA Collective Action Settlement!

PKG brought a collective action lawsuit under the Fair Labor Standards Act (“FLSA”) against Bojangles OpCo LLC, alleging that Assistant General Managers were misclassified as exempt employees and therefore were unlawfully denied overtime pay for overtime hours they worked.

After more than two years of litigation and intense negotiations, PKG was able to obtain a settlement of $260,000 on behalf of more than 200 collective members who were allegedly harmed by this misclassification. Recently, the Western District of North Carolina approved this settlement as fair and reasonable. Because of the efforts of Logan Pardell and Bryan Giribaldo, these collective members will be receiving significant compensation for their claims within the next couple of months!

PKG Obtains Approval for $950,000 Settlement in FLSA Collective Action Settlement!

PKG, along with co-counsel, brought a collective action lawsuit under the Fair Labor Standards Act (“FLSA”) against Alight Solutions LLC captioned Rogers, et al. v. Alight Solutions, LLC, Case No. 1:23-cv-16387 (N.D. Ill.) alleging that call center workers were unlawfully denied pay for the time they spent booting up their computers and loading necessary programs before being "call ready" at the start of their shifts.

After more than two years of litigation and intense negotiations, PKG was able to obtain a settlement of $950,000 on behalf of approximately 1,000 collective members who were allegedly harmed by this policy. Recently, the Northern District of Illinois approved this settlement as fair and reasonable and an excellent result for the collective members. Because of the efforts of Logan Pardell and Bryan Giribaldo, these collective members will be receiving significant compensation for their claims within the next couple of months!

🎉 PKG Secures Class Certification in TCPA Class Action 🎉

We’re proud to celebrate Alex Kruzyk and Logan Pardell on securing class certification in Iudiciani v. The Seyboth Team Real Estate Inc., Case No. 1:23-cv-00443-MSM-AEM (D.R.I.).

The court’s ruling allows the case to proceed on behalf of a class of consumers who allegedly received telemarketing text messages, despite being registered on the Do Not Call Registry and without providing prior express written consent in violation of the federal Telephone Consumer Protection Act (TCPA).

This important step reflects our firm’s continued commitment to protecting consumer rights and holding companies accountable for unlawful telemarketing practices.

PKG Obtains Final Approval for $250,000 Settlement in TCPA Class Action Against Farha Roofing!

PKG brought a class action lawsuit under the Telephone Consumer Protection Act (“TCPA”) against Farha Roofing LLC alleging that they, and related entities, unlawfully delivered telemarketing text messages to class members’ personal cell phones without first obtaining written consent.

After more than a year of litigation and intense negotiations, PKG was able to obtain a settlement of $250,000 on behalf of approximately 5,000 class members who received these text messages. Recently, the Western District of Missouri approved this settlement as fair and reasonable, particularly given the excellent per-person recovery in this settlement. Because of the efforts of Alex Kruzyk and Bryan Giribaldo, these class members will be receiving significant compensation for their claims this fall!

ANNOUNCEMENT: PKG Wins Conditional Class Certification in FLSA Unpaid Overtime Case Against Auto-Chlor System!

PKG represents former Auto-Chlor System Branch Managers (“BMs”) who claim they were misclassified as exempt employees and therefore wrongfully denied overtime pay for the significant overtime hours that they worked. Specifically, these BMs claim that they worked well over 50 hours per week and were required to perform substantially the same job functions as hourly-paid Route Drivers who were paid overtime.

Plaintiffs filed a collective action lawsuit in the Northern District of California on behalf of all BMs who worked for Auto-Chlor System nationwide. Shortly after filing this lawsuit, PKG filed a motion to conditionally certify the class of BMs, which would allow them to send court-authorized notice to every BM who fall within the nationwide class definition. Despite significant opposition by Auto-Chlor System, the Court granted Plaintiff’s motion in its entirety! While, Auto-Chlor System made an effort to limit the scope of the notice with subsequent briefing, the Court rejected this attempt and reaffirmed that notice will be disseminated nationwide.

This big win for Plaintiffs was led by Logan Pardell, PKG’s lead employment law attorney. Because of his efforts, notice of this lawsuit will be disseminated to the putative class in the coming weeks!

Since we began investigating whether car dealerships were assessing previously undisclosed fees to customers looking to buy out their car leases, we learned that this issue has been pervasive throughout the country. Despite dealerships unlawfully assessing these fees at alarming rates, many customers just assume that they are required to pay these fees without legal recourse.
