VERDICT ALERT!
Dyson Law just finished a 6-day jury trial involving a trust that was created from a medical malpractice settlement for a disabled daughter (our client). The trust was supposed to provide for her for the rest of her life.
After an argument between mother and daughter, the mother (who was the trustee) stopped giving her money from the trust. The daughter ended up living in her car while the trustee continued withdrawing cash from the trust accounts.
On behalf of the daughter, we filed a lawsuit to force an accounting, remove the trustee, and recover the money that had been taken.
The trustee countersued and asked the jury for $1.25 million in damages against the daughter.
After the trial, the jury:
Found the trustee breached her fiduciary duty
Awarded damages for money taken from the trust
Rejected the trustee’s claims against the daughter.
Trust cases are often the hardest cases because they involve family, money, and broken trust all at the same time.
