⚠️ IMPORTANT IMMIGRATION UPDATE ⚠️

On May 23, 2026, USCIS issued Policy Memorandum PM-602-0199, fundamentally changing how adjustment of status (green card) applications will be handled for individuals already in the United States.

Under this new guidance, USCIS officers are instructed to treat I-485 adjustment of status as an “extraordinary” form of relief — not the routine pathway it has been for decades. Most applicants may now be directed to complete their green card process through consular processing in their home country rather than from within the U.S.

What this means for you:

✅ Already-approved I-485 cases are not affected
✅ Change of status (Form I-539) is not affected
✅ H-1B and L-1 visa holders may have more protection under dual-intent rules
⚠️ Pending and future I-485 applicants face heightened scrutiny. The new policy does not suspend I-485 (green card) applications from within the United States, however applicants may be required to prove that “extraordinary circumstances” prevent them from using consular processing.

This is a rapidly evolving area of law and we are monitoring developments closely — including potential litigation challenging this memo.
