Who would ever expect Elon Musk to join as a party plaintiff alongside major news publishers? We knew AI and Intellectual Property would be hot topics the last two years. And things definitely were stirred up when Elon Musk joined as plaintiff last year in the lawsuit against OpenAI by The Times and other media outlets for copyright infringement. If you recall, Musk is a co-founder and early investor in OpenAI but dont think Musk is truly aligned with the other plaintiffs. Since OpenAI (like most AI free services) terms and conditions claim intellectual property rights (copyright) to any generated works, the publishers are upset and claim that OpenAI is stealing their copyrights to AI generated news articles. However Musk’s concern is that OpenAI is in violation of its own intended purpose which was free information, everything is public domain.

But what should concern attorneys utilizing the AI services to generate legal documents is that this includes any confidential client PII (Personally Identifiable Information). And of course this raises concerns of PII being open and accessible to third parties. Pay close attention when using AI services to generate legal documents: De-identify your client’s PII.

Something worth sharing - just in case - time is of the essence if you get cyber-scammed!

We have a client that sold his/her home - a significant sized deal - 7 figures. A day after the sale, Seller received an email purporting to be from the title company stating that an error had occurred and that Seller needed to wire the funds back to the title company. This email wasn't from a "Nigerian Prince" - and looked somewhat legit. Of course, it was a scam with a bogus account where the funds would have been wired. Luckily, the scam was identified and the funds were not wired. But this had us thinking - somewhere, sometime this scam has worked and if it had here, Seller would have had serious issues because there would be no recourse to recover those funds. The deal was done so the lender, title company, purchaser, attorneys, etc., were no longer involved - and more than likely insurance coverage would not have covered such a loss. It would have been utterly devastating to Seller if Seller was off Seller's game that day and somehow fell for the scam. It sounds like "common sense" but always be aware and check, recheck and then check again to ensure requests are legitimate. We are all under constant cyber attack - even as I write this. If a request seems odd even in the very least or you do not recognize requesting agent - investigate further and ask some questions. Simple due diligence can identify a scam and protect you from serious, serious harm. If you are somehow taken by such a scam - don't let embarrassment hamper you - it happens - contact your attorney and authorities immediately as time is of the essence to recover.

The Lanham Act is FUCT’d, Iancu v Brunetti, Supreme Court strikes down Act in part as violating first amendment rights in that it discriminates based on an applicant’s viewpoint. Section 2a of the Lanham Act currently excludes "immoral, deceptive, or scandalous matter; or matter which may disparage or falsely suggest a connection with persons, living or dead, institutions, beliefs, or national symbols, or bring them into contempt, or disrepute."
