Our practice involves helping professionals deal with board issues ranging from alleged drug diversion, addiction issues, patient safety issues, and all other aspects of the regulation of the Pharmacy Profession in Alabama. These are the general steps that we recommend you take if you are under investigation or have been questioned at your job. 1. If you have been terminated from employment, you should request a copy of your complete personnel file immediately.
2. If you have been accused of using or diverting controlled medication, you need to contact us immediately for further information.
3. If you have received a letter of investigation from the board or you have been contacted by an investigator, our advice to you is consult with an attorney prior to making any statements or making any decisions about the temporary status of your license.
4. Prior to meeting with the board or the board’s investigator, you should retain counsel to enter an appearance on your behalf and advise you through the process.
5. You do not need to talk about your case with anyone other than those people authorized by your attorney. Many times evidence that you provide will be used against you throughout the process.
6. Although the administrative process as it relates to a professional license is different than the criminal process, you definitely need an attorney to advise you and to negotiate for you and to speak on your behalf. Many times things are said and done by a professional without counsel that can be extremely detrimental to your cause and can result in much more serious consequences as it relates to your license. Arguments and aspects can be explored that you may not be aware of whenever you are looking at your case alone.
7. Do not discuss your case with co-workers, former co-workers, pharmacist friends, pharmacists previously disciplined by the Board, etc. This will not help and will likely make you more anxious and worried and will confuse you. Every Board matter is different and the facts of each case are different.
