Injured on the Job? What are your rights?

Most workers know that when they are hurt on the job, with few exceptions, they are entitled to worker’s compensation benefits. To obtain benefits, you must notify your employer immediately that you have been injured. Worker’s compensation will pay for your medical treatment and also will pay you 2/3 of your average weekly wage up to a maximum amount for a period of time, depending on your injuries and disability. While worker’s compensation can be a life ring for a period of time, worker’s compensation benefits in Alabama are among the lowest in the nation.

Thankfully, for seriously injured workers, there is often a third party, someone besides your employer, who has responsibility for your injuries. This is often the manufacturer of a defective product that injured you on the job. In that case, you have your worker’s compensation claim against your employer and a products liability case against a product manufacturer. You can recover much more in the products case than in the worker’s compensation case. A products case is just one example of a third party that may be liable. There are many others who may be responsible. However, many lawyers do not have the expertise to understand and identify the third party that may also be responsible. HOW LONG DO I HAVE TO FILE A LAWSUIT FOR COMPENSATION FROM A TRUCKING COMPANY?

You have 2 years from the date of your accident. For example, if you had a wreck with an eighteen-wheeler on April 15, 2022, you would have to file a lawsuit on or before April 15, 2024, or your lawsuit would be time barred. However, you should never delay contacting a Birmingham truck accident lawyer immediately after your wreck. If the wreck resulted in serious injuries or death, the insurance company for the trucking company will have investigators out at the scene immediately. If your lawyer does not have the opportunity to conduct an investigation soon after the wreck, valuable evidence will probably be lost or changed. COVID RESTRICTIONS COME ROARING BACK! PLEASE LET ME KNOW HOW YOU ARE ADAPTING
Some hospital ICU's are over 100% capacity with COVID patients. Alabama has the highest positivity rate from testing in the United States, while at the same time having the lowest or second lowest vaccination rate of any state. The Jefferson County courts have gone back to full masking, as have the United States District Courts for the Middle District of Alabama. The Montgomery County courts have canceled two jury terms. That is just the tip of the iceberg for what is probably coming.

The Florida Supreme Court has put in place procedures for remote trials. Having just finished a securities arbitration conducted by Zoom, I can tell you first hand that we do not want to do that in Alabama.

I would love to hear from you about how you are adapting to the latest perils and restrictions imposed by the COVID virus. Are you continuing with trials with a mask on? If so, how have you changed your trial techniques? Do you plan for you and your staff to continue working at the office or are you going remote? What precautions are you putting in place to protect you, your office and your families?

Everyone in my office is vaccinated, but when anyone not working here comes in, the masks go on. I will probably have some trials masked, but I plan to take a microphone and amp to the courtroom so the jury can hear me through the mask. Of course, all depositions will probably be by Zoom,
