I am deeply saddened to share that our legal effort to stop the Heritage Plantation HOA Board's plan to eradicate the neighborhood geese was unsuccessful today.
My clients went to court to be a voice for the voiceless. Unfortunately, the law often prioritizes rigid definitions over moral obligations, and the court ruled that the imminent harm to the geese was not enough to satisfy the legal definition of "irreparable harm" to our clients.
While the HOA Board may view this as a legal victory, it is a moral failure. They have won the right to proceed with killing these geese, but they cannot erase the fact that their community stood up and said, "Not in our name."
But make no mistake: this does not absolve the HOA Board.
We fought the good fight. We gave everything we had to protect these beautiful animals. The Board may have "won" in a courtroom today, but they have to live with the reality of what comes next. They chose eradication over coexistence. They chose destruction over compassion.
While some may see this as a courtroom victory for the Board, I am infinitely prouder to be the attorney who stood up to protect these helpless animals than to be associated with the decision to destroy them.
The Madison and Huntsville community will remember exactly who stood up to protect their local wildlife—and exactly who decided they had to go. Thank you to everyone who supported us. The fight for a more compassionate community doesn't end here.
As this process moves forward, we are hoping to secure video footage of the eradication itself. The public deserves to see exactly what this decision looks like in practice, and we fully intend to share it openly so everyone can truly see the raw reality of what has been done here so that this injustice is brought completely into the light.
I want to thank my incredible clients, their neighbors and community who poured their hearts into trying to save the geese.
We didn't get the outcome they deserved, but we showed what many in the community truly value: compassion, protection, and life.
The Board's actions will now be their permanent legacy.
