Safer Roads for Alabama!!!
Today Gov. Kay Ivey signed Senate Bill 242 and made an important step in Alabama's ongoing effort to improve highway safety and address unlawful practices within the commercial trucking industry. This new law focuses on ensuring that commercial truck drivers operating on Alabama roads are properly licensed, legally authorized to work in the U.S., and able to communicate in English at a basic level. Even better, the new law creates criminal penalties for individuals who present fraudulent foreign CDL's or operate large commercial vehicles without proper documentation.
For those of us who work in trucking litigation and accident investigations, these issues are not theoretical. We have handled several investigations where large language barriers have created significant obstacles when trying to determine what actually happened in a crash. When a driver cannot to effectively communicate with a law enforcement officer, critical information can be delayed or never obtained. Even basic questions about the driver's route, hours of service, training, or what they observed before the crash can become difficult to answer. In these instances, the investigation can be slowed down and liability determinations can be complicated, particularly in serious crashes involving catastrophic injuries or a fatality.
This is great for victims of truck crashes as these standard matter in the courtroom. When trucking companies allow drivers to operate without meeting these basic requirements, it raises serious questions about the company's hiring practices and safety oversight. Ultimately, the goal of this law is simply to ensure safer roads for Alabama families and accountability for companies that put unsafe drivers behind the wheel. We are all for it!
