Y’all. I’m a fan of the Constitution, the Rule of Law, the Separation of Powers. So, I’m not a fan of this EO. Or many others that have come out of this administration. If you, like me, think the Constitution is pretty neato and you’d like to keep it, please seek factual information and not talking points about these things. An administration using an executive order to target lawyers and law firms for doing their job is outrageous. And not in the Jem-and-the-Holograms-Jem-is-truly-outrageous kind of way. In a very serious, very not good kind of way.

Update on the 504 thing:

On Wednesday, the 17 AG’s said in a Joint Status Report to the court (paraphrased), “oh. Noooo no no no no. We didn’t mean 504 is unconstitutional **on its face**! We didn’t ask for that.” (They did).

They go on (paraphrased): “We just meant it’s unconstitutional to apply 504 requirements to stuff that’s not authorized under the Rehabilitation Act.” (They meant what they said).

The May 2024 Final Rule integrated standards from case law like requiring the “most integrated setting,” and the AG’s are challenging that, they say. They did not file an amended complaint though. They just put a couple paragraphs in a Joint Status Report.

The people who wrote the complaint and the AG’s that signed onto it, they’re lawyers. Presumably not absolute crap lawyers. They know what they wrote. It takes some serious mental gymnastics to pretend that they didnt seek to declare 504 uconstitutional when they requested in the complaint’s Demand for Relief that the court (direct quote incoming…), “[d]eclare Section 504, 29 U.S.C. § 794, unconstitutional.”

Maybe what the AG’s meant in the Joint Status Report is more like, “oops, we said the quiet part out loud. Y’all weren’t supposed to know we’re trying to dismantle civil rights laws yet. Look away. Nothing to see here.”

17 state attorneys general (AG’s) have joined in a lawsuit asking that the court declare Section 504 unconstitutional. This is not good. It is bad.

The lawsuit does *not* only seek to unwind the May 2024 rule related to 504, as some are saying. The complaint argues that Section 504 is unconstitutional. It asks the court to tear down the whole dang thing.

“Oh, the court won’t do that,” some say. Yet, these AG’s have gone far enough to ask. To put this demand for relief in an actual complaint. To look at this complaint and decide “yep, let’s take down Section 504.” To put their name and reputation, as an attorney and a public figure, behind a formal (if flabby and disingenuous) request to remove protections for people with disabilities that have been in place for more than 50 years (and that are 100% constitutional).

These AG’s all made an oath to uphold the Constitution. They’re failing to stay true to their word. If the AG’s are willing to file the request, what reason do we have to believe a court wouldn’t grant it? Cross your fingers, y’all. That oughta do it, right?

You may think “small government” and “government efficiency” is super neato. K. Fine. Skip that. This, what’s being done via this lawsuit and in many other ways, is not that. This is not getting rid of “bloat” and giving power to the states (y’all. really.). This is like wanting to downsize as an empty nester, but instead of buying another house and moving, you bulldoze your entire house. And your entire neighborhood. And everything within 10 miles of your neighborhood. Then you tell all the people whose homes you destroyed that their property values just shot up because of all the usable space they have now.

TLDR: 17 state AG’s are asking a federal court to declare Section 504 unconstitutional. That’s bad. If you think it’s good, either you’re ill informed or you’re also bad (NB: there are no bad kids). Call your AG’s office, people.

A lot of people are worried about their kids right now. What will this mean for them, in school, and in their future lives. We have no answers today. But, we have each other. And lawyers!

One of my favorite scenes in is when Bing B**g loses his wagon over the edge and he's really upset. Joy wants him to just get up and move and "Save Riley!" She's really positive and persuasive.

But Bing B**g is too sad to move.

It isn't until Sadness sits with him and gets him to talk about the wagon and what it meant to him that Bing B**g changes. He can express his feelings because someone gave him space to do so. And when he expresses his feelings, he can finally get back up and help them help Riley.

Sometimes you need to feel Sadness before you can move. And you need to take time before anything else happens.

Today is going to be a hard day for a lot of us. Don't rush through your feelings. When your time is right, you'll be able to move. And when you move, we will ready for you to join us.

All this advice is useless for people with ADHD. Don’t you think if we could do all this stuff we would do all this stuff? Yeah, we would. Nobody wants to be chronically late or anxiously early all the time. Nobody wants to constantly be looking for their keys, wallet, school binder, pencil, sheet for a parent to sign.

Planners would be awesome! Never have I found one that’s “the answer.” Nor do I know any ADHD adult who has. Because they’re a neurotypical tool. Easy. Simple. What’s the big deal? Well, we don’t freaking know. Stop shaming kids (or yourself, or other adults with ADHD) for not being able to keep up with using a planner! Better idea: get a planner, hyperfocus on it, do all the stickers and the color coding and junk, fill in as much as you can for the whole year, use it for 2 weeks, leave it home for one day, forget it exists, and then **be okay with that**! Get a new planner (when you’re ready, if you want to). ADHD loves novelty!

“Get more exercise,” “get enough sleep,” “create a routine,” blah blah blah blah blah.

If you are a neurotypical person trying to help an ADHD person with crap advice like this, just don’t. You’re not helping. You’re shaming and being ableist. That’s it. That’s the message.
