Your supervisor pulls you off light duty the same week the insurance company's doctor sends in his report. You never got a copy of what he actually wrote.

Under Montana law, your insurer may send you to a doctor of its choosing for an independent medical exam. That doctor is picked and paid by the insurance company, not by you. His opinion carries weight, but it isn't the final word on your case. If it conflicts with what your treating doctor says, that disagreement gets resolved by the Department of Labor and Industry or the Workers' Compensation Court, not in the exam room.

One visit. That's what your check can hinge on, unless you push back with your treating doctor's written opinion and the records behind it.

You've been rescheduling physical therapy around your kid's basketball games for weeks, waiting on an insurance decision. Then it comes back: denied. That word feels final, but in a Montana workers' comp case, it's not the end of the file. It's the start of a different clock.

To keep the claim alive, you must first file a Petition for Mediation with the Department of Labor. This is a semi-formal process, where you should definitely consider hiring an experienced attorney. After the mediation, the mediator will issue findings. Depending on the findings, you can decide whether to file a Petition with the Montana Workers' Compensation Court.

Contesting a claim denial is TIME SENSITIVE. If you face a denial the clock begins running as soon as you receive the letter of denial. Failure to challenge a denial within the time sensitive window can lead to claim closure and denial of all benefits. Don't battle the insurance company alone. Call us: 406-888-2222.
