❓If you lost your California EDD appeal, what should you do next?

➡File an appeal with the California Unemployment Insurance Appeals Board. This is time sensitive and must be done within 30 days.

➡The appeals board will review all evidence and will issue a written decision. Should the Appeals Board find that they believe the original decision by the administrative law judge was wrong, then the decision will be reversed or modified.

➡All Board appeals and petitions must be filed in writing with the office location listed on the ALJ’s decision.

➡Use appeal form DE 1430 available online to file your appeal to the board.

❓Undergoing an EDD appeal? Did you know that you can request to view your case file?

➡This can be incredibly helpful in preparing for your case. You may arrange to review this file by contacting the Office of Appeals to which the hearing has been assigned. The Department case file should reveal the information gathered by Department representatives in making the determination being appealed. Once you review this material you should have an idea of what you will need to challenge or support the Department’s conclusions.

❗HELP! I forgot to file my EDD appeal and it is now late!

➡ You may still be able to file an appeal successfully even if it is late if you have and can prove GOOD CAUSE for missing the deadline.

➡ Good cause generally means you were prevented from making the deadline by circumstances beyond your control and which could not have been reasonably anticipated.

➡ Reasons for this may include events or
hardships that could be substantiated with documentation to prove that there was good cause for the delay.

📢EDD Update

California's May revision on the budget contains new money for EDD, including $136 million for what's called EDDNext. This is money geared toward the call center, benefit systems, and more, in order to modernize EDD's systems.

The budget also puts forth roughly $40 million to combat fraud, with some money going to investigators and district attorneys across the state; this will span over a three-year period.

Unfortunately, those who have collected unemployment or who are currently on unemployment are experiencing the effect of this very broken system right now — a system requiring $136 million in order to fix.

❓Undergoing a California EDD appeal hearing?

‼KNOW YOUR RIGHTS!

➡Each party has the following rights at the hearing:

1. The right to 10 days’ advance written notice of each issue that will be discussed and decided.

2. The right to be represented by an individual of that party’s choosing.

3. The right to testify on that party’s own behalf on each issue.

4. The right to present and question witnesses on that party’s behalf on any matter relevant to the proceeding.

5. The right to present relevant documents and other exhibits as proposed evidence to be included in the official record of the case.

6. The right to review the case file and any document or other exhibit that is presented by another party as proposed evidence.

7. The right to object to the questioning of any witness, the conduct of the hearing, and the ALJ’s inclusion in the official record or exclusion from the official record of any proposed evidence.

8. The right to question any other party and any witness who testifies on behalf of any other party on any matter relevant to the issues involved.

9. The right to impeach any witness regardless of which party first called the witness to testify.

10. The right to present rebuttal testimony and evidence that explains why information presented by another party should not be believed.

11. The right to provide a closing statement that explains why the party believes the decision of the ALJ should be in the favor of that party on each issue involved.

❓Did you know that even if you owe the EDD an overpayment, you may still be able to lessen the amount?

➡The EDD classifies overpayments as either fraud or non-fraud.

➡Fraud: If the EDD believes that you intentionally gave false information or withheld information, the overpayment is considered fraud. You will have to pay a 30 percent penalty in addition to the overpayment amount. You may also be disqualified for future benefits for up to 23 weeks.

➡Non- Fraud: If the overpayment was not your fault, it’s considered non-fraud. You will receive a notice telling you if you must repay the overpayment or if they need more information to determine if you were overpaid.

➡If you are subject to an overpayment, you should still appeal the false statement penalty as it could greatly lessen the amount that you must pay back.

❓Did you recently submit a paper or fax application to the EDD for unemployment benefits?

➡The EDD has experienced a recent influx of paper and fax application fraud which has resulted in them halting or slowing the processing of paper and fax applications until further verification is received from the applicant.

➡The EDD announced recently that due to massive fraud attempts with these methods, applicants may receive a notice in the mail requesting further action on their part to verify their application before approving benefits.

➡If you were denied due to this, the decision can be appealed. File your appeal within 30 days of denial to obtain the benefits to which you are entitled.

‼Help! My tax refund was sent to the EDD!

➡The EDD works with the IRS, the State of California Franchise Tax Board, the California State Lottery, and the California State Controller to collect any debt you owe from an Unemployment Insurance (UI) or State Disability Insurance (SDI) benefit overpayment.

➡If you received a Notice of Overpayment (DE 1444) because you were paid UI or SDI benefits that the EDD believes you were not eligible for, the EDD can collect unpaid debt by reducing or withholding the following:

-Federal income tax refunds State income tax refunds
-State Lottery winnings
-Funds from unclaimed property
