PET DEPOSITS… As of July 1, 2024, and continuing in 2026 under Assembly Bill 12 (AB 12), California landlords generally cannot charge a separate pet deposit that causes the total security deposit to exceed one month's rent. Any upfront, refundable payment for a pet is considered part of the security deposit and is subject to this cap.
Key 2026 Pet Deposit Rules in California:
Total Cap: The total security deposit (standard + pet deposit) is capped at one month's rent.
Refundable Only: All deposits must be refundable; "non-refundable" pet deposits are prohibited.
Small Landlord Exception: Landlords who are natural persons (or LLCs with natural person members) owning no more than two properties (max 4 total units) may collect up to two months' rent as a total deposit.
Service/ESA Animals: Landlords cannot charge a pet deposit or pet rent for qualified emotional support animals (ESAs) or service animals.
Pet Rent: Landlords may charge monthly "pet rent" (e.g., $25–$75/month), which is not capped by the security deposit law.
