ESTATE PLANNING FOR PARENTS OF SPECIAL NEEDS CHILDREN

Parents of a developmentally disabled or otherwise incapacitated child bear a life-long burden of care. In fact, after their child turns 18 it gets harder. As an adult, the child is not permitted to continue participating in many programs that were available during school-age years. And adults with special needs encounter many challenges not faced as children.

So, what happens to the child after parents have passed away, or can no longer continue to provide essential care and supervision? Who, other than the parents, are both willing and able to step up and assume what could become for them, as well, a life-long burden? Will the child have enough money to pay for his or her unique and often challenging medical, housing, social and vocational needs?

Join the lawyers at Vasiliadis Pappas Associates for a FREE one-hour webinar to explore answers and solutions to these questions.

A durable general power of attorney allows you to appoint someone you trust to step in for you to handle financial and legal matters if you become incapacitated. We all are at risk of incapacity from illness or injury, whether temporary or permanent. Of course, this risk rises as we get older. Without someone in place to handle legal and financial matters, bills can go unpaid, contracts can’t be signed, homes can’t be refinanced, leases can’t be terminated, investments go unmonitored and unadjusted, and families often fight over who is in charge. Being named someone’s “Agent” (in earlier times referred to as “attorney-in-fact”) under a power of attorney can feel like an honor — and a lot of pressure. A financial power of attorney lets you handle certain money and property matters for the person who signed it (the “principal”). There are also health care powers of attorney. But here we discuss financial ones. Read more here: https://tinyurl.com/39c4dvft

For all but the very wealthy, prudent retirement and estate planning includes legal measures to protect against the cost of financially ruinous long-term care. Nursing homes in Pennsylvania cost $150,000 – $180,00 a year. Medicare and private health insurance don’t pay for this. Medicaid does, without any dollar caps or time limits. Nursing homes in Pennsylvania typically cost $150,000 – $180,000 a year. Medicare and health insurance don’t pay. Medicaid does, without any dollar caps or time limits. But you must first go broke in order to qualify and, if you’re married, your spouse could forfeit a substantial part of his or her estate as well. Poverty is the price of admission into the Medicaid program. But with proper planning your hard-earned money can be protected for spouse and family without forfeiting benefits eligibility.
