“… The court is not satisfied that the music was at a level to negatively affect a reasonable person,” 85th District Court Judge John Mead said Tuesday, at the close of a hearing in a case brought by Homestead Township against Kirk Jones, a local winery owner and beekeeper.
Homestead Township’s controversial noise ordinance, which attorneys from a downstate law firm argued was an entirely appropriate way to control noise, prohibits sound which annoys a reasonable person of normal sensitivities.
The judge did not strike down the ordinance — that wasn’t argued — he simply decided there was no merit to the complaint that precipitated the ticket. …”

"... The suit asks the court to compel the jail to provide people who are incarcerated with medically assisted treatment for opioid use disorder if their doctor calls for the medications, Davidson said.
Records show the jail, which contracts with Wellpath, a Nashville-based corporate health care provider, does provide Vivitrol for those with opioid use disorder, but does not provide Suboxone.
Vivitrol is injected, Suboxone is taken orally and some clinical studies show Suboxone is more successful in preventing overdose deaths.
The Americans with Disabilities Act is a civil rights law, passed in 1990, that prohibits discrimination based on disability. The Affordable Care Act classifies addiction as a disability when it substantially limits a major life activity, such as caring for oneself, working and communicating.
The Eighth Amendment prohibits the federal government from imposing unduly harsh punishment cruel and unusual punishment on criminal defendants. ..."
Bensley and Barsheff could not be reached for comment; Undersheriff Mike Shea said he had not been served with any legal documents related to the suit.

“A district court judge has again ruled the court cannot order jail medical staff to provide specific medications to people incarcerated — though questions remain over sentencing directives as well as a corporate healthcare provider’s interpretation of its own prescription medication policy. […]
Sheriff Tom Bensley said the victims of crime were too often forgotten in discussions over jail inmate healthcare, adding that he supported the judge’s ruling.
“These were sentencing orders to the defendants, not to the jail,” Bensley said Friday. “It’s pretty simple – don’t go to jail. And if you do, you’ll be treated by the medical professionals we hire.” …”

"A motion hearing in district court turned contentious when a supervisor for a corporate healthcare provider under contract with Grand Traverse County’s jail, was questioned under oath about the company’s medication policies.
Wellpath supervisor Elaine Kaiser previously gave public comment at a county board meeting, though attorneys said the remote hearing Wednesday in 86th District Court was the first time a representative from the company — a defendant in dozens of federal lawsuits — was questioned under oath in a local court.
The Wednesday hearing was an attempt by a local defense attorney to compel the company to administer prescribed mental health medications to two men who are serving sentences in Grand Traverse County’s jail.
“The court has pointed out the obvious — they are involved in a lawsuit — but they showed up at this hearing, I’m calling them as a witness, I’ll let the court make the determination but I would like to take some testimony from Wellpath,” said attorney Jesse Williams. ..."

Attorneys William Maze and Murray Duncan convinced 34th District Court Judge Brian A. Oakley to suppress DataMaster DMT evidence in three drunk driving prosecutions.
Judge Oakley suppressed the DataMaster evidence and he opined during the December 17, 2020 hearing that: "I think as I read through these briefs - one of the things that bothered me the most about this is it seems like the [Michigan] State Police have a major problem, and then they spend a year trying to hide it, instead of fix it. Actually more than a year, I think. And you know there's already enough distrust in the public about what we do in the system. That's offensive to me. And Ms. Foley-Carter, I don't see any way we can get past the foundational question, which is the 120 day test. You're not going to get anybody to testify on it. There's no way I can see that [ex-Intoximeters Inc. employee Andrew] Clark is going to not show up. Even if he shows up, and not just claim the fifth [amendment]. I'm granting the motion [to suppress] on all three files."

Jesse’s personal background and upbringing in a large, working class, family has molded him into an extremely focused attorney with a strong desire to win. Jesse works tirelessly representing clients' legal interests in both criminal cases and civil litigation. His reputation as a zealous legal advocate is well established throughout Michigan. In the past few years, Jesse’s team has grown to include two additional attorneys. They are Frederik Stig-Nielsen and Mary (Betsy) Mas.

Along with their staff members Eric VanDussen and Jenn Ryan, the team at Jesse L.
