Dear Heather Marie-

This letter/post serves as a formal demand that you immediately cease and desist from using the business name “ELITE HAIR BY HEATHER”, which is registered with the State of Oregon under The Paralegal Beagle, LLC., Registry # 2544519-91.

Under ORS 648.007(1), a person may not carry on business in Oregon under an assumed business name unless that name is properly registered to them. Additionally, ORS 648.135 authorizes civil action against anyone who uses a registered business name without permission, including the recovery of damages and injunctive relief.

Because the name “ELITE HAIR BY HEATHER” is legally registered to me, your continued use of it constitutes unauthorized use of a registered business name under Oregon law. This includes use in advertising, branding, social media, websites, printed materials, and any other business operations.

To resolve this matter amicably, I am willing to sell you full rights to the business name “ELITE HAIR BY HEATHER” for $750.00, representing the original debt of $400, $50 to register The Hair Fairy, $50 to register Elite Hair By Heather, and paralegal fees to drafts both Cease and Desist letters, and legal research. Upon receipt of full payment, I will promptly transfer ownership of the registered name to you, remove the Cease and Desist Notices and consider all matters settled.

If you choose NOT to purchase the name, you must immediately discontinue all use of “ELITE HAIR BY HEATHER.” Failure to comply within 10 business days of the date of this letter will leave me no choice but to pursue legal remedies available under ORS 648.135, including but not limited to injunctive relief and recovery of damages.

I hope we can resolve this matter quickly and professionally.

One question: Do you have a Revocable Living Trust? If not, you should! One of the saddest calls I get are from heirs that need to file a probate because their parent did not have a Trust. The process is a nightmare, takes months and is VERY costly.
