There's a document that most of my clients have never heard of, and for certain families, it matters just as much as a Health Care Proxy.

It's called a MOLST form, Medical Orders for Life-Sustaining Treatment.

Unlike a Health Care Proxy, which names someone to make decisions on your behalf, a MOLST is an actual medical order, signed by your doctor, that EMS and hospital staff can act on immediately in an emergency.

It's meant for people managing a serious illness or advanced age, when the wishes need to be immediately actionable, not just documented.

A Health Care Proxy and a MOLST aren't competing documents.

They do different jobs.

One names your voice.

The other gives medical providers instructions they can follow on the spot.

I bring this up because I've seen families assume a Health Care Proxy covers everything, and then be surprised in a moment when a physician's order is what was actually needed.

If you or someone you love is managing a serious health condition, this is worth asking your doctor about directly.

If you own a business in Massachusetts, your estate plan isn't finished until it accounts for that business too.

Here's what a lot of business owners don't realize: your will alone doesn't transfer control of your company the way you'd expect.

Depending on how your business is structured, your family may not have clear authority to manage it, pay employees, sign contracts, or even access accounts while your estate moves through probate.

A buy-sell agreement, along with the right language in your estate plan, spells out exactly what happens to your ownership stake, who has the right to buy it, and how that's valued, well before anyone needs to guess.

I work with a lot of business owners who've done everything right personally, a will, a trust, the whole plan, but never circled back to protect the thing that actually supports their family day to day.

If your business has never come up in an estate planning conversation, that's the gap we should close next.

If you opened a custodial account for your kid or grandkid, here's a number worth double-checking.

Most people assume that money becomes theirs at 18. In Massachusetts, a UTMA account actually stays under the custodian's control until the child turns 21, unless you set it up differently from the start.

I bring this up because I've seen families genuinely surprised, in both directions.

Some assume their eighteen-year-old will inherit control of a college fund and get caught off guard when they can't access it yet.

Others assume they've lost control at 18 and hand over an account three years earlier than they needed to.

It's a small detail, but it matters, especially if that account has real money in it and you're trying to time things around college, a first apartment, or just plain maturity.

If you've set up custodial accounts for the kids in your life and aren't sure which age applies, it's worth a quick check.

Do you need a will, a trust, or both? 🤔

This is one of the most common questions I hear when talking with families about estate planning, and the answer isn't always as straightforward as you might think!

A will helps make sure your wishes are known, but it doesn't keep your family out of probate court. A properly funded trust, on the other hand, can help avoid probate, protect your family's privacy, and give you more control over how your assets are passed down.

But here's what I always remind my clients: Not every family needs a trust, and a more complicated estate plan isn't necessarily a better one.

This is one of those laws I hope you never actually need to think about, but it exists for a reason.

Massachusetts has what's sometimes called a slayer statute.

In plain terms, if someone causes another person's death, they're legally barred from inheriting from that person, no matter what the will, the trust, or a beneficiary form says.

The law simply won't let it happen.

I mention it not because it comes up often, but because it says something important about how Massachusetts estate law works.

Your documents matter enormously, but they don't operate in a vacuum.

There are protections built into the system that exist specifically so the worst-case scenario can't be exploited.

Most of what I help families with is far less dramatic than this.

But it's a good reminder that the law is paying closer attention to fairness than people usually assume.

Life Lately has been full of everything I love: family, friends, and a little bit of sparkle.

First up, Savannah and I headed to West Palm Beach for the Miss America pageant, and I'll say it out loud, I really do have a pageant daughter.

We cheered so hard for our favorite team all night, and it was such a thrill watching Miss Texas take the Miss America crown, with Miss Utah's team taking home the Teen title.

All of the girls on that stage were incredible.

Next up, two Red Sox games in one stretch.

First with my best friend since high school, Kaitlin, who I'm lucky enough to still call one of my closest friends, and then again with Emily and Savannah.

Both nights were a blast.

Then Savannah and I spent an afternoon decorating the house for Halloween.

I wanted it to feel warm and festive for my clients when they walk through the door, not just for us.

And last but not least, I got to host a seminar at the Norfolk Senior Center on estate planning.

There's nothing like a room full of people ready to get their affairs in order.

Grateful for a season this full. ❤️
