What Are “191 Findings” in Washington Family Law?

In Washington State family law, “191 findings” refer to findings made under RCW 26.09.191, a law that allows the court to place restrictions on a parent’s residential time or decision-making when certain serious concerns exist.

These findings may be based on issues such as:

• Domestic violence
• Child abuse or neglect
• Abandonment
• Substance abuse that affects parenting
• Serious mental health concerns that impair parenting
• A history of abusive or harmful conflict

If the court enters 191 findings, it can limit a parent’s time with their child, require supervised visitation, restrict decision-making authority, or impose other conditions designed to protect the child’s best interests.

Parental alienation is one of the most heartbreaking issues a family court can face.

When one parent intentionally damages a child’s relationship with the other parent through manipulation, false accusations, or constant negative comments, the child is often the one who suffers the most.

In Washington State, courts focus on the best interests of the child. Judges want children to have healthy, meaningful relationships with both parents whenever it is safe and appropriate. While “parental alienation” isn’t specifically defined in Washington law, behaviors that interfere with a child’s relationship with the other parent can become an important factor in custody and parenting plan decisions.

Examples may include:
